I immigrated to Canada on January 19th 2005. Im a Permanent resident and my wife is a citizen.
I want to know if I can visit to India on my Indian passport around June/July 2006?
It will be around a year and half after staying in Canada. I only want to visit india for a month and wants to come back. But I have heard from somebody that before Three (3) years I cannot travel outside canada anywhere, otherwise I wont be able to qualify for citizenship, and even I will lose my permanent resident status.
Please help me as its very important for me to find out.

Im in a real confusion and I would appreciate if somebody clears it up so I can relax.

the info you got is crap. of course you can travel. You are not a prisoner here. you have to keep up your PR card you have to be in canada for 365x3 days out of 5 yrs. i.e 1095 days out of 1825 days. how you do it is up to you. you can live here for 2 ys and go back for a year and come back to canda in the 4th yr. what ever permutation you do they should add up to 1095 days in 5 yrs. so go back and have a good holiday. enjoy
best wishes

janmeja,

Your info is wrong about the days. I have noticed that you tend to jump to advising people very soon without confirming the facts on legal issues. It would be advisable if you refrain from doing so (earlier you had advised wrongly about tax on incomes earned overseas) or do it after reading/understanding the facts.

Traveling overseas for a month is perfectly ok. You will not lose your PR status. However, you may just have to wait an extra month after completion of 3 years of living in Canada in order to apply for citizenship, if you prefer to apply for citizenship immediately after 3 year residency completion.

I have been traveling to Europe on business every month for a week and when it was time to apply for citizenship, all I had to do was wait out all those "lost" days in order to accrue 3 yrs out of 4, before applying. Hope this helps.

chandrashekhar : i was not wrong with taxes. my advise was according to my personal experience. as far as traveling abroad yes i mistook the dates for citizenship . you need to have 2 yrs out of 5 but he can travel in an out of the country.

as i told you before my advice is on personal experience.

Two mistakes again

It is chandresh, not Chandrashekhar!

Secondly, what you have written about your own case - it is wrong, if you have earned income overseas (whether brought into Canada or not) after landing into Canada and not reported in your Canadian tax returns.

One more mistake - the 5 years mentioned by you is not for citizenship - it is 3 years out of 4 years.
