I'm a canadian citizen living and working in Gulf. I left in the mid of Year 2003.
I wanted to establish my own business in Canada before going back in two years time but never gone back so asked my brother to open a company in my name before the end of 2004. I provided my SIN card number and other details. My brother gave these information to an accountant to open a company for me. I didn't sign any paper.
Later on my brother moved to US and he didn't contact anyone living on that postal address.
My company registration letter was delivered on canadian address. Ministry of finance keep on sending me reminder for filling my tax returns. at last after three years somehow my brother went back to the old residence in canada and foud so many letters. last letter from ministry of finance shows that i have to pay very big amount as retail sales tax. Because the company was registered as sole propritership. It was a computer company.
I'm living and woorking her in Gulf and couldn't go back to canada. For my new born baby i applied canadian passport and received it in one month time but with one year validity only. Now i'm waiting for his ciitzenship card for last 8 months. i came to know from a friend that before issuing citizenship card candian immigration and citizenship will check my status.
I want to sposor my wife but i'm worried what to do. if they will ask my to pay income tax on my international income from gulf?
I'm so much worried about this comuter company which was opened on papers only but become a problem for me. Please advise me what to do now. how to proceed?

You are a Canadian Citizen and you left Canada around the middle of 2003.

Your Brother and an Accountant opened 'A' company, for yourself, at the end of 2004 with your SIN card and with a Canadian Postal address. You don't know where it is or if there was anybody to forward the mail to you where you live, to your address in the Middle East. You did not sign these documents for the opening of that account. You have copies of the same or can avail the same from the Accountant. Get them as fast as you can to CYA.

Later on your brother moved to the US and he didn't contact anyone living at that postal address.

Your brother who got the company started for you, moved away to the USA. Three years later he went back and collectd all of the mail, including the request for the Income tax returns. You have the company registration papers and a permit from the Sales tax people. You also have a Vendor's Permit from them. The Sales Tax people are demanding a huge sum of sales tax for the goods purchased and then subsequently sold by that company. Which you are now identifying it as a Computer Company. Do you agree or deny it?

While you lived and worked in Canada, did you file tax returns? Did you file one for the year you left? Have you filed any since then?

You are now living and working in The Gulf (Middle East) and couldn't return back to Canada.
Since you are working in the Gulf you DO NOT want to come back to Canada.!

It is normal for them to check on the child and the Parents and see where they are before they issue a Citizenship Papers to them. Find out how to get it from them. If you cannot write with details, get some one to draft one out for you. Was the child born in Canada? (I don't think so.)

Now you want to sposor your wife but you are worried about all of these items and do not know what to do. If they will ask you to pay income tax on your International income from Gulf?

You cross the bridge when you come to it.

You now want to sponsor the mother of the child as a PR to Canada. You are worried if they will ask you for the taxes that you owe to them at that time?

For the time being, all you want to know now, is, what to do with the company that you opened, but it is dormant and does not conduct any business?

Since you are a Canadian Citizen, living abroad in the GULF Region, and working there, write a letter to the Sales tax people, at the address given in the Registration Papers, (You have their mail) telling them that there was no business conducted on behalf of the company EVER and there is no income there to report. Don't sign the letter. So, there is no Sales Tax to pay or report. Please MAKE SURE that it is 'FROM' the SAME CANDIAN Address to which they are sending the demand notice. Their reply will be mailed to that address. Let it stay dormant at the same location. DO NOT CHANGE the address. Courier it to Canada and ask the courier to mail the same to the Recipients with a Canadian Postal Stamp. If you do not know how, please pm me here or drop a note to me at my hotmail dot com address.
Now for the Income Tax Return to be filed on behalf of the company, you DO NOT have to respond to their demands. After the lapse of a few years, I think it is five, they will close the company and write to you that YOU don't have a company any more. That reply will also go the same registered address. Ask them to save it for you. NOW, be truthful and tell us, 'Did you or anyone buy things on behalf of the company with the Sales Tax Registration Number'? If so, the seller's Invoice and his word will CRUCIFY you. Since you are a Canadian Citizen, you cannot escape the Penalty, does not matter where you go and work or where you live. All your sins and omissions are yours and everything will follow you like your shadow.

Use your phone and call, or write to the Canadian Consulate there in AbuDhabi and ask them how to renew the Child's passport after one year? Fill out the papers and mail the same with the required Fees and a Prepaid Return Envelope, after they give you the instructions.

You are a Canadian Citizen. Hence, you can fill out an application for your spouse from the Gulf Region with the required Fees and wait for the completion of the process. When they provide you with a time span to Enter and get her PR Card, take a trip to Canada with the child and the Mother and complete the formalities. At that time, collect all of the mail from the canadian address, have a nice vacation and return back to the Gulf or any other region that you want to go and carry on with what ever you are doing. I don't know what you can do to get your wife to re-enter into Canada after the firstr PR?

Now for the Taxes on the Global income:
Do you have a Canadian home or an apartment, or a local address?
Do you have a OHIP or any Health insurance Card?
Do you have a Canadian Driver's Licence?
Do you have a Bank account or a Credit Card issued to you in Canada?
Do you have a loan or a lline of credit with a Bank?
Do you belong to any association or a member of a group?
Do you have a clearance from the Income Tax Department saying that you are deemed to be a Non Resident of Canada?
Did you fill out their form and get an O.K or a pre approval?
There is an automatic Expiry period for some of these. Do you know about it? If So, have they expired now?
Are there any dependants for you in Canada?
Did you sponsor anybody while you were here in Canada and are they still dependents to you? If so where are they now? If so what is the period of obligation?
Also did you forget to pick a pair of pants that you left on a clothes line to dry in anyone's back yard?
It gets sillier, because to sever ties with Canada, it is a long list of things to do and I am no authority on this subject. But surely, I will point and whistle to you. It is your choice and you have to follow it to completion. But I want to close this letter for now.

These are a few basic questions that you can answer to yourself. I would suggest that you contact a good Tax Consultant to sort out the Tax implication.
You can ask others on this CD or on other Immigration web sites, as to how to sever relationship with Canada, if that is what you want to do. Also, what are the basic steps to take and other requirements to follow? At the same time ask the Canadian Government too. They have publications that come out out of your ears. Ask them to provide you with a link to their web site and don't forget to send it to us too.

India has surpassed Canada in economic development and will be a very powerful Nation in times to come. Use the same to your advantage if you want to decide the retirement issues at a later date. Your child is a Canadian now, so you can also study the PIO or OCI cards to return back, in case that is what you want to. But for now your situation reminds me of 'A Monkey on a split log with its tail wedged in'. Be gentle while trying to dislodge it.

Yes i have received copy of Master Business Licence (sole propritership)
but not Vendor's permit and have no idea about it.
Yes it's a computer company.
Yes i always file my tax returns for each year. last time i filed it before april 2003.
Never used sales tax registration number.
Before coming back i cancelled my OHIP card and Bank Account but not driving licence which is expired two months back. I don't have any other ties with Canada.

I can't renew my son's passport without citizenship card for which i'm waiting for last 8 months.
i have prepared all necessary documents to sposor my wife. I'm attaching company letter shows my monthly salary and the expiry of my current contract. I'm afraid based on my company registration in Canada may be they will consider me resident of Canada and i have to pay tax on international income. Actually i never applied for non-resident status.

My younger brother asked to the same account to file my tax return showing zero income. which has already been done.

Now my worrie is shall i dispatch sposorship papers now or wait till i will resolve this retail sales tax problem.

Actually i want to move back to Canada for good next year. Whenever we will go for my wife's landing we won't come abck to Gulf. I want to go to the University for higher studies.
