can I work in US with Canadian PR

Hi there

I know that one can work on TN visa with Canadian citizenship but not sure with just PR.

It would be much appreciated if someone can clarify the following questions:


1. Is a Canadian PR eligible to work and live in US? If so on what visa?

2. If not is applying for H1 visa from Canada the same procedure as from India or is it easy from Canada.

3. In my profession there are good job oppourtunities in US than in Canada. So I would like to work in US. But I have only Canadian PR and not citizenship. So what are my options.

Need your expert advice please.

-- Your only option is H1B (and find an employer who is willing to sponsor it).

How long will take to get the Canadian citizenship once you meet the eligibility criteria (2 year stay out of 5 yrs in Canada on PR).

Is the time line different in different proivinces. For eg can you get quickly in Saskachewan than in Ontario (Toronto).

Your help is much appreciated.

Citizenship is a 2 step process. One at the "federal level" and the other at the local city/region. I would assume the first step at Nova Scotia would take pretty much the same time for most applicants as most applications go in one queue. Once the apps is sent to your local citizenship office, then the timing might vary depending on how crowded of a city you live in and the amount of resources available at that citizenship office to process.

In most normal cases, it might take about 9 to 15 months based on what I know.

-- The "2 out of 5 years" is the rule to retain your PR status. You need "3 out of 4 years" to qualify to apply for Canadian citizenship. This 4 year window moves (changes) with time and therefore your time for citizenship could be affected depending upon whether the 2 year qualifying period you spent in Canada to retain your PR status was spent continuously or not.

-- If you are asking about the time required to get the citizenship - the answer is yes, the time required when you are residing in "smaller" provinces (like SK) could be less as compared to living in Ontario.

The cross-border tax is a complex topic and cannot be generalized in one statement like what you have stated above. So in order to avoid confusion, it is best not to advise if you do not have enough or correct information, especially when the person is asking completely different question, unrelated to taxation.
