Also my statement above is based on real experience of minor travelling recently in March 2015.

What difference ?

I said upto the age of 20 , everytime the Child's Canadian PP is changed , you also have to get the OCI reiisued as their face changes. This is ON the embassy website, and you said that's NOT true, when its entirely true.

20-50 , you DON'T have to do that. You can just carry BOTH the NEW & OLD Canadian PP with you.

Just because you were able to recently travel doesn't mean that the rules have changed. The Indian official at the airport was incompetent & didn't follow the rule & you were extremely lucky to get through. Someone else might NOT be so lucky.

Again what's below is ONLY till the age of 20 , NOT after that.

This is from the Embassy website :

" Although the OCI Card is a lifelong card, the Card and the Life Long Visa sticker that comes with it must be replaced EACH time a NEW passport is issued:

• For an applicant who is 20 years of age or younger ,OCI documents must be re-issued after the issuance of a new passport in view of biological changes in face of the applicant. "

I am not going to argue with you further, just to clarify for you:
1. I replied regarding PP up to 20 years only.
2. Personal experience of minors travelling with old PP and OCI booklet, not only of self but of friends as well, something corroborated by AG later on.

While you are right about the rules - we are speaking from ground realities. There is quite often the difference between what the website states and what really happens on ground.

Hope all clear and #nohardfeelings :)

My original post was also regarding PP up to 20 yrs only and was about rules only ( not ground realities)

No one is asking you to argue, but DON'T spread misinformation & confuse people by calling a correct post ( posted by me ) as being Untrue , when just the opposite is true :)

The only person who needs clarification is you & NOT me..as I have posted the right information & rules, as far as OCI & PP is concerned upto the age 20.

Does any want to take a risk & ruin their vacation by having the kids sent back from the Indian airport, because they DIDN'T follow the official rules, and just went with some ground reality based on the experience of a couple of people ?

What do you tell them, when they rightly point out that your kids HAVEN'T followed the OFFICIAL rule & DENY your kids entry ?..that some friend & his friend's kid were allowed entry ?..so my kids should also be allowed entry, bcoz its a so called ground reality ? ..aka CHALTA HAIN attitude ?..NOT the official rule of the embassy or India ?

When coming into Canada , don't your kids follow the official PR , Citizenship , Entry rules or do they just go with some ground reality ? Its NOT any different , when its the other way round either, when going INTO India.

I have a peculiar case and wonder if anyone can help.

My whole family became Canadian citizens in 2004. We got our passports cancelled after getting the citizenship/Canadian PP in 2004 soon.

For my wife and children I got PIOs (I don't remember why), but for myself I got OCI - and I was below 50 at that time.

Between 2010 and 2013, I went to Consulate as well as BLS three times to renew my OCI (due to new passport as well as turning 50) after doing the needful for renewal thru web and getting a number. Each time they said that I need a Surrender Certificate - even though the form for OCI clearly said that people who got their Canadian citizenship before 2009 do not need a surrender certificate (which is logical since there was no surrender certificate in 2004 when I surrendered my Indian citizenship). The problem they found with my passport was that it had a stamp of Cancelled - but not the stamp of Cancelled since the holder voluntarily acquired Canadian citizenship. (Funny - the three passports of my 3 family members all have the long cancelled stamped but not my passport!)

So after trying it twice without success, I finally decided to apply for surrender certificate - thought it would be $25 but atleast get it done with the silly practices of Indian authorities. But no, now they ask for a penalty - since I did not get the surrender certificate when I did acquire my Canadian citizenship.......(WTF!!!???)

So now what am I supposed to do???

Just a money making scheme this penalty fees & SC fees. ( SC = Surrender Certificate )

In your case you did everything right & DON'T have to pay either the penalty fees or SC fees, as you did it before 2004 , when ALL this nonsense didn't exist.

Inspite of that they are trying to LOOT you as they CAN'T bear to see that you have done every thing right, but somehow due to the typical DESI bribe & looting & red tape & bureucracy & vague/ambiguous rules ..they STILL WANT TO LOOT YOU ..for NO fault of yours.

Because your PP just says '' CANCELLED " ..they are falsely & indirectly assuming that you have stamped the PP yourself. They are NOT telling that to your face, but that's what they are assuming. Its kind of hard to ( but not impossible ) to get the LONG stamp yourself.

So NOW they want to penalise you for their mistake & NOT yours..due to this stupid wording on the stamp.

I know a guy who had a 20 year Old ..EXPIRED ..Indian PP lying around. Who the hell is going to travel on that ? How the hell can you travel on a 20 yr old EXPIRED PP ? Now they just want to rubber stamp "CANCELLED" on it & charge him the STUPID RIP OFF fees , before issuing him the OCI.

Wef 29th Jan 2015 , OCI s would not be asked to produce their Passport containing the U Visa. The OCI card would be sufficient .

This does away with the need for getting the U sticker affixed every time the foreign passport is renewed ..

--------------------------------
Note: Vide circular No. 26011/06/2015-OCI dated 29th January, 2015 of Ministry of Home Affairs, Government of India, all immigration authorities in India will not insist on production of the foreign passport containing the 'U' Visa Sticker in the case of OCI Cardholders while they enter / exit India and the immigration clearance will be granted based on production of the 'OCI CARD ONLY'.

So say you are 20 & get a OCI card & have a Canadian PP with U Visa sticker on it.

Fast Forward 40 years ..now you are 60. You will probably have 4 new Canadian PP in those 40 yrs at 10 yrs each.

So if now you travel at the age of 60 with a Canadian PP with your aged photo on it , but you still have an OCI card from when your face was 20 yrs old .

Both the photos won't match at all..the one on the OCI card & the Canadian PP .

Even if they NO longer need your PP with the U Visa on it & OCI card is enough for entry . Will they force you to update the OCI card itself ?..I hope NOT !

Adamthorat - then what is the purpose of the new circular ?

Can you please provide some links to cases where the circular will not apply ?

Is there any eligibily requirement to get oci? Is it not that any NRI can apply?

Why would an NRI need to apply for OCI ?

He is already an Indian citizen...
