Applying for H1B .... with caution

This is a continuation of the thread started by Manjeet Bathe, offering a list of recruiters sponsoring H1B. First of all, I must thank Manjeet for providing the list so promptly.

Now I want to value add my 2c to the process. One of the most important questions that pop up while considering H1B sponsors is - how do we know that these companies are genuine ? No easy answers .

Perhaps the best advice would be from employees already working for that company, but where do you find them when you need them . So I am mentioning some websites which may be useful.

1. http://www.path2usa.com" rel="nofollow">LINK - Check the discussion forum covering Employers. There are a host of bloggers who have asked for or posted their opinions on various H1B sponsoring companies. In fact amongst the threads I found a link to an excel spreadsheet mentioning cases pending against companies who have not paid/partially paid their H1B employees.

2. http://www.immigration.com" rel="nofollow">LINK - Under the Employment information forum , there are a host of companies posting H1B vacancies and some bloggers expressing their opinions.

3. Check out http://archive.flcdatacenter.com/casesearch.asp
This is a government website, which lists the H1B application status for each sponsoring company for 2000 - 2003 . Although it does not tell you about the company, at least you get to know if the company is an old hand at sponsoring H1B candidates or a newbie.

4. Check out Dun & Bradstreet - if you have access to it.

Read this before applying for H-1, you really have to be careful as in to deal with right people.

I am again a little confused about this H1 thing. It is a category of visa, right?
Who applies for it? Do I apply for it or does the sponsor do that for me? How does the process work?

I mean it is the employer who gets a labour certification. The he looks up and decides to hire a person in India or wherever.

What happens then? Does the selected candidate fill up an application and submit it to the US Consulate? What has to accompany the application? Does the employer provide something like an appt letter etc that goes with the application?

Who pays the processing fees? I think the current fees etc total to around US$3000 or so. Does the candidate have to deposit this fee? Does this amount get re-imbursed or is it an expense in the process?

Right. Its a work permit - it allows the worker to work in the US for 3 years and can be renewed once for another 3 years (giving a total of 6 years on H1B). Under special circumstances one can seek 7th, 8th, ... year H1 extensions ad infinitum. Those who dont qualify for 7th/8th year must leave the US and stay outside the US for atleast one year before they are eligible for a new H1. Of course, if the person gets a Green Card or EAD (one step before final Green Card) he does not need to maintain H1 status and can stay and work in the US.

The employer has to apply for the H1 Petition. The process is fairly simple - the employer first seeks a Labor Certification Approval (LCA) from the Department of Labor. This is a simple 24-hour fax-back process and should not be confused with Labor Clearance process for Green Card. Then the employer sends the Approved LCA along with the H1B petition to INS. The HB petition basically states te employees qualifications, his job responsibilities and the pay they are offering and the work conditions to USCIS (formerly INS). The INS takes its own sweet time (anywhere from 2 to 6 months) to review the petition and approve (or deny or request more information). The H1 Petition costs around $2500 and odd in INS Fees, add lawyer fees to that (or it can be done by employer). If you want the petition approved soon, you can ask for Premium Processing in which USCIS guarantees you a response (not an approval) within 2 weeks of receipt. Add another $1000 if you want premium processing.

The candidate has to apply for Visa to enter the US. He fills up an application form, attends interview at US Consulate where they review his petition and his documents and, if successful, is given a 3 year multiple entry H1 Visa for self and H4 Visa for dependents.

The employer is supposed to pay for the H1 (and dependent) H4 processing fees. Most small companies prefer to pass this expense to consultants. It remains a matter for negotiation between the eployer and the employee. Hiwever all large companies pay for the H1 Processing fees themselves and do not seek reimbursement from candidates. Beware of companies that seek payment upfront for H1B processing.
