Thats why I said you get the person on TN and get him working (and making $$ for both parties) and then apply for his/her H1.

TN is a visa that has to be renewed every year and is entirely dependant on the whims of the immigration official at the border. A refusal to grant that visa cannot be challenged either.

I agree with you Partha. You're right. But even then there is always that element of doubt and the consequent insecurity.
I would like to get some information on the working of the H1b stuff.
From what I have been given to understand until now, a potential employer files the H1b petition with the INS.
For the current year I think it has started recently, the filing of petitions I mean. Once the petition is filed, the INS decided on whether to approve or reject.
Now the number of H1 petitions that can be approved is a fixed number, right? Somewhere around 65,000 for this year, right?
Given these conditions, what criteria does the INS use to select between two or more identically qualifed persons? Is it on a first come first served basis?
Since the number of H1bs is limited to a fixed number, what factors are considered important to improve chances getting one? Any insights?
