Dear All,

I’ll be really grateful to the immigration experts if they provide a bit of insight in this case.

I would like to invite my mother on super visa. My mother doesn’t have any property or other source of income to proof and she is solely dependent on me (every quarter I transfer money in her bank account).

I came to Canada in 2011 along with my wife and daughter and worked in 2 different companies and in early 2012 I landed up a decent IT job in Municipal Corporation. In April 2012 we were blessed with baby girl now she is 9 months old.

I have been to different blogs regarding parents to show family ties, property or fat bank balance. It is bit confusing so I thought to have best guidance from you guys.

Your immediate help will duly appreciated.

Here is some material that I found for you to read.....

Q. What are the humanitarian and compassionate factors that would be considered in such a case?

A. The C.I.C. would consider the number of close family members living both in Canada, as well as in your parents' country of citizenship. If the Court feels that no one in your parents' country of citizenship can adequately look after your parents and the majority of the family is here in Canada, these are humanitarian factors that would be in your favour. The Appeal Division would also assess the severity of the illness and the degree of hospitalization or medical care required.

Q. I recently came to Canada as a landed immigrant. I have been in Canada for less than a year and I want to sponsor my parents and my 15-year-old sister. Can I do it?

A. The Immigration department maintains a chart known as a LICO chart (low income cut-off) that determines how much money you must be earning in the 12-month period prior to your sponsorship which in turn depends upon the number of people in your family in Canada, as well as the number of people you wish to sponsor. As long as you have earned this income, in the 12-month period prior to your application to sponsor you will be considered financially qualified, even if you have earned the required amount in only a three-month period.

Low Income Cut Off... is LICO. Here is the chart.

Low Income Cut-Off (LICO) Size of Family Unit Minimum necessary income
1 person $22,637 (the sponsor)
2 persons $28,182 wife/spouse
3 persons $34,646
4 persons $42,065
5 persons $47,710
6 persons $53,808
7 persons $59,907
More than 7 persons, for each additional person, add $6,099

Get a letter of employment from your Job, first.

You can get an "OPTION C" printout of your tax details from CRA.
Also you might have a NOA from them too.

An invitation letter from you with all of the details from your Mother's Passport and with an Open Return Ticket/ OR One way ticket with a confirmed return voucher will do too. See if the Travel agent knows about it too. You can buy the ticket here in Canada.

The Annual insurance for a visitor could run you between 1500 to 3000 dollars. Check with the local issuing agent for a concessional rate. Their issue might be an yearly policy and the renewal might depend upon the claims that you make. Get a TENTATIVE COVERAGE from an issuing agent.

The C.I.C. are currently a little liberal with their issuing of this SUPER VISA. Enjoy using this feature and getting a Visa for your Mother.

If your purchase of the ticket is from India and your Mom is traveling for the first time, then, ask the agent to see if he can issue the ticket when there are parties that are traveling to Canada, and together with the group or travelers, of course with their consent.

Ask an accountant to see if you can can claim her as a dependent once she gets to stay here in Canada as a Visitor, after 181 days...(I am not sure about it)

Thank you so much Full House for providing me an in-depth detail. You have covered points which i haven't thought of.

I'll go as per your instructions. I meet all the expectations of LICO and I have the NOA for last year. The only concern is we don't have any assets in India and she is totally dependent on me. So is there a possibility of visa being rejected on the basis of insufficient funds or family ties in India.

There are TWO scenarios..

1) No one there in India to help or take care of your Mother and not enough income to support herself there and you are supporting her from here.

a) Would she get a SUPER VISA to join you here? If she does then Super Visa is great and you ultimately won the battle.

2) If not, then their own findings and with their refusal, you will be in a better position to apply for her PR into Canada. Impress upon them that she has no support at that end and no income to survive and hence needs to get her PR as soon as possible. That way you both will be reunited here.

Hope she has maintained her good health and will get through her medicals.

When a dependent is visiting you here on a Temporary Resident Visa, TRV, you are not permitted to claim any support payments or any deductions for him/her.
