Fellow Desis,

I have been a silent reader of the posts in this section. I am in a bigger dilema than most of you. I am at the next stage, (labour and 140 approved)but due to being a born Indian citizen, the next stage 485 would take minimum 3 yrs to complete.

I am a landed immigrant in Canada as well, and am seriously contemplating of moving up there. Just wanted to touch base with Ex-H1B's if there is somebody in my kind'a of situation.
So seriously confused, about what to do............
Any advice/suggestion is highly appreciated.

Canada is grate country to live, it is as good as USA, little bit colder but OK, people are friendly and very good education.

I am kinda onthe same boat.My H-1B finishes in april 2008, which means i should have filed my GC application by april 2007.
My present employer does not sponsor green card which adds up to my dilemma.

I am kinda in 2 minds now

1) Find a new job In US, and file my green card before April 2007 and then wait till eternity to get my Green card.

2) Move to canada( have PR) . Still have to find a job their first and likely take a hit on salary.

Ha! if one only life was a little simpler.

It's a tough decision but not tough if you decide whether you have confidence in you abilities or not.. Money is function of luck, economy, hard-work and other things.. If you are married consider your wife's income.. if you are getting married consider what she would presumably earn in US v/s Canada assuming she can get H1B converted etc...
All in all.. unless you have some self-hating need to keep living in limbo you would probably be better off in Canada.. provided you move there after initial job offer..

Please remember that the filing has to wait for about 2 months or more while ads are placed and all those formalities happen. So even though this is only December you would be pushing the envelope if your deadline is april 2007 and you also have to get a new job. However, if you can get your PERM and I-140 processed through premium processing(took about 5 months for a colleague.. do not have any other metrics regarding this) then you would have more badwidth. I am not suggesting one way or the other about either of the 2 options noted.. just pointing out some things that you may not be aware off. My own green card filing is about to happen under premium processing because I have only till May 2007 before my 6 year limit ends. Irrespective of that I am still planning to come to Canada by March 2007 so that my wife can get employment. Being on H4 for so long sucks.

Souvik,

My H-1B technically expires in april 2008 and i thought that i have to be filed by April 2007 for future extensions.
But in your previous post you mentioned that you are doing premium processing of labour and I-140 now when your 6th year expires in May 2007.

This is definitely good to know since it gives me more bandwidth now, if i do premium processing can i be filed by like october 2007 too. Is that correct? Please update.

i see you work in US while you are living in Canada,That is definitely better i guess (pay wise) but then it's still like rocking in 2 boats. You win some you lose some. That's life.

Dear Friends

Due to Retrogression and Labor certificate backlog eliminated center, I have decided to move Canada so my wife and kids sty Canada and I will stay in USA.

My question is when I get Labor approve (hope fully end of the September 2007) Does it require that my wife and kids to be present in USA when my employer file I-140? And next extension of EIGHT YEAR H1B?
