Can I sponsor my parents and my brother who is married

Dear Massood Ji and other Experts,

I am going to sponsor my parents and want to include my brother as a dependent child of them.

Now the definition of a dependent child is:

Who is a dependent child?
Your child or a child of the person you are sponsoring will be considered a dependent child if that child
A. is under the age of 22 and not married or in a common-law relationship; or
B. married or entered into a common-law relationship before the age 22 and, since becoming a spouse
or a common-law partner, has
• been continuously enrolled and in attendance as a full-time student in a post secondary
institution accredited by the relevant government authority and
• depended substantially on the financial support of a parent; or
is 22 years of age or older and, since before the age of 22, has
• been continuously enrolled and in attendance as a full-time student in a post secondary
institution accredited by the relevant government authority and
• depended substantially on the financial support of a parent; or
C. is 22 years of age or older, has depended substantially on the financial support of a parent since
before the age of 22 and is unable to provide for himself or herself due to a medical condition.


My brother fulfills B category. He was married at 21 years, but has been studying till then and is also dependent on my parents. He is 23 now.

So can I include him?
Will he get immigration?
What other parer work is needed?
Do we need to give his wife's details now at the time of application, or when asked?
Does he need to fulfill the dependency conditions at the time of interview too? Because he is in LLB first year, and will continue to be enrolled there till 3 years.

Please advise.

If your brother is married, he is not dependent on your father. Probably you can't sposor him.

if he's married, he is no longer a dependent.
