Dear Sirs,
My wife is going to give birth on Aug 25th. So we applied for visitor's visa to new delhi. me and my wife earn $120,000 a year and i showed $40,000 in my bank account. New Delhi wanted them to do medical tests which they did at Apollo Hospital chennai. The visa was submitted on June10th.
By mistake , the lady doctor who examined my mother in law wrote that she could hear a murmer in the heart. So new delhi rejected their visa and told them to do detailed further tests if they needed the visa like heart monitor and to see if TB grew on the Sputum (by keeping it under observation for 6 weeks). They also clearly wrote in the letter that they canot expect to get a visitor's visa before sept. 25th ( if their medicals did not show any problem.
Now when they again went for medical check up with the same doctor at apollo, she became afraid and told them that she did not write that there was a murmur in the heart at all and was very sorrowful that their visa got rejected due to her fault ( this was the first day). she took the heart reading and said that there was no murmur at all. The next day when she called them for further heart exam she was behaving very rude ( the immigration mail told them to go to THAT PARTICULAR DOCTOR/ HOSPITAL only) and said that they will also have to do further medical tests that were not in the letter sent by new delhi. she also said that she will watch the sputum for 8 weeks (and not 6 weeks) and send them the reply. this whole process took about rs. 25,000 (for FIL and MIL). the doctor (male and another one) who examined them, remarked that he will write to new delhi telling them that they were asking applicants to do further medical tests even though the initial ones were very satisfactory.
My father in law and MIL have got visitor's visa very easily to UK and France (where they will visit their another daghter).
Now my Query is this :
1. Can i sue the New Delhi CHC or Appollo Hospitals for this ?
Have any other desi's experienced this kind of problems
2. Their medical status is under progress. can they apply again when in London, UK and tell the immigration that they are trying again. I am sure that the London, UK embassy will also ask them to do another medicals
3. We did not inform new delhi canadian embassy that they are coming to care for a pregnancy. we just told them that they are coming for a short visit. Can i use this reason to get a free caregiver from the canadian govt..

What do other senior and experienced desi's advise me on a situation like this. My wife was really looking forward for her mum to come during delivery and now she is devestated. she cries frequently and she is reall afraid (also after seeing that the canadian medical system is not upto standard. She is giving birth at st. josephs. We asked them for help but they said that no help was / will be available.

I am a Gents and not a Ladies.

My dear friend, getting a visa to any country is not your right. It is a previlage granted by that particular country. Even if you sue CHC, you will not get anything in return. Regarding, Mistake( ?) from doctor from Applo , Chennai, i doubt you can proove anything till the time all tests are done again by a independent Doctor/Hospital. So, be paitent, let the results come & than contact CHC for visitor visa.
