Hi ,
This is the second query I am posting in this forum on the same day as I wanted to keep it separate from the last one as the background is slightly longer .
I had first landed in Canada on July 7th ,2007 on an immigrant visa and got my PR card issued with a date of July 23rd 2007 and went back to India for some urgent property and family issues .After that I never went back to Canada though I filed my income tax return in Canada twice in the last 3 years and also maintained my bank account in a Canadian bank .
Now I am planning to go back to Canada for a job search in the first week of July 2010 , though the issues for which I went back still persist but I don’t want to loose my residency .To know if I could comfortably land in Canada after this long gap without hard questioning or grilling with the immigration authorities in Canada ,I sent a query regarding this to the Canadian High Commission in New Delhi and this what they replied with.
“You may proceed to Canada with your valid Indian passport and Permanent Resident Card. However, be advised that when you arrive at the Canadian Port of Entry, you will have to undergo a residency determination.
Upon arrival in Canada, an officer will determine if you meet the residency obligation required to maintain your status as a permanent resident. If you meet the residency obligation, you will be allowed to enter Canada. If, however, the officer determines that you have lost your permanent resident status, the officer may issue a report and refer it to the Minister's delegate for review. If the Minister’s delegate finds the report to be well-founded and insufficient humanitarian grounds exist, the Minister’s delegate shall issue a removal order against you”
With my simple math ,I could calculate that I am still qualifying to be in Canada as my 3 year period would expire on July 23rd (the day I left from Canada in 2007) .
Could someone please advise if I am right in thinking that I have not lost my residency and also, what type of questions I might be asked by the immigration authorities when I land in Canada.
Thanks
So, expect to get questioned in that line.
But you do have ample cushion as you have stayed here two weeks after the 7th of July. So you can enter around that time period and will be allowed to enter and stay here, but they will ask you a few basic questions and will be let inside.
They will ask you anything to declare??
Do 'declare all of the FUNDS, booze, and smokes that you bring in and any other goods to follow'. If you have a list, present it too.
Good Luck.
Freddie.
Thanks for your inputs Freddie,Appreciate it .
