1. I am not 100% positive it's a law. I say that because, I have crossed with my 3 year old when he was 2, 1, etc without my wife both into US and back into Canada many, many times without being asked anything. When I do get asked, I'll post my experience

No, it's not ridiculous, because he/she may be a biological child, but there are possibilities that the parent does not have legal custody due to, say, divorce, criminal history, etc etc. If you have observed Amber Alerts, most abductions happen by a non-custodial parent or very close relative. Someone the child may not have an issue being with.
Anyway, spouse's letter does not make it fool proof. Anybody can create a letter. Delays occur at the border when the officers are verifying the contents of the letter.
