Detroit - Windsor Commute

I am in US on H1B & have received my final papers for canadian PR.

Need help from the board here:
1) Can I do my landing & mave back & stay in Detroit.
2) Or will it better to stay in Windsor & commute to detroit everyday?
3) Any complication of travelling back & forth at the border?
4) If I choose to live in Detroit for a while, do I have to file for taxes in Canada still?


Basically, if possible I would like to maintain my job in detroit if possible for now. And at same time not ruin my canadian PR.

If you move to Windsor, Canada and commute to Detroit, MI, you will be establishing yourself in Canada and will qualify for your Citizenship times sooner.

If you want to stay there in Detroit and not pay taxes to Canada, even a small amount, that is O.K.too. But you have three years to decide which is better and where you would like to stay for the rest of your life.

Whatever you do, tell the Canadian Immigration Officer at the time you are entering to become PR here, that you are moving into Canada for GOOD and provide them with a Canadian Address for paper trail.

1. Yes you can live in Detroit. If you want to maintain your PR status, there is a certain number of years you can live outside Canada before having to move to Canada.

2. Choice is yours. There are tons of people who live in Windsor and commute to Detroit.

3. No complications at the border as long your US immigration and PR status have no complications. If you are a citizen of a country that requires a visa to enter the US, then you will need a valid visa at all times along with a valid I-94.

4. You will need to file taxes in Canada only if you are deemed a resident for tax purposes. Normally, that means, if you have residential ties to Canada, then you are a tax resident. Holding a PR status does not automatically make you a tax resident. So, yes, you could live in DTW and not file for Cdn taxes.

Just to clarify - regarding the number of years you mentioned. I am assuming that comes in question - when applying for citizenship &/or renewal of PR?

Also, if I have a residential address in windsor (which I will need anyways when I land) - then I guess I have to pay taxes, even though I earn & live in USA.

If you wish to accrue time towards citizenship, satisfying residential requirement is essential. For PR status, like Freddie stated, you can be out for 3 years in a 5 year period. After that, you either move to Canada or risk your PR status.

You don't need a Cdn address until you really want to move. But it's up to you. If you do establish residential ties, you may have to pay taxes in Canada.

When you cross the border and enter Canada, telling them that you are going to settle here for Good, they will be wanting a local address to which they can send you with A PR Card with your picture on it. You apply for it here in Canada providing them with a local address. That is mailed out to you the first time when you enter and apply.

They will be sending it to your place of (residence) where you want the mail to reach you with all of their welcome documents. If you do not provide them one you do not get it. If after applying, in case there is a glitch, they will write and tell you all about it, the material will be arriving at the address that you provide them with. Then it returns back to them if it is not picked up. They hold it for six months and DESTROY it soon after that. They do not mail it to an address outside of Canada. So, you make your arrangements here in Canada to receive the same.

Hence the need to have a local mailing address to which they can send you the PR cards. You will need this (these) when you cross the border back into Canada for the first five years, as a proof of Permanent Residency.
