Hi all CD's
My bad luck, Yesterday night at around 11.00 p.m. i got an accident with my family at near dixie rd and Queens st.
I went to one of my friends house to see his new born babby, at night when i returned from his house i got an accident with one car. I was taking right turn from building and suddanly one car came from my leftside and I hit with that car. I did not saw the car due to a Big hill of Snow put on the leftside. Even luckily i had camera with me and i took some photos on spot of my car and situation. When i took slightly down my car on the road and i hit car which was driven by black lady with her family.
Now lady told me she is working with insurance co. and she called the police, but my bad or may be good luck Police told the black lady if both car are driveable than we will not come but you just exchange your information and infom tomorrow to collision centre. and there was not witness. I asked lady and she was agreed to fix car outside of insurance issue, but she told me to sign on papar that i am agreed to pay all expenses will occur to fix her car. Her car both passanger side door bend and scratches. My car got damage only front bumper and lic. plate torned. Now my questions are:
1. As per rules am i in fault or Not?
2. If yes is it advicable to inform myside first to ins. co. or i have to wait for the call from lady?
3. If i am involve my insurance co. Please anybody explain how much percentage of my insurance will increase as these my first involvement in accident.
3. If i am going to fix my and her car outside will cost me around $3000, is it worthful to pay outside or should i involve ins. co?
I know in these site so many questions are rising like me and you people help each and everyone. i am really in now trouble and more in confusion to what to do? If any suggestion will be very helpful to me...

My honest opinion is to talk to your Insurance Agency to save all the unexpected hassles. I've heard in some cases the premium doesn't increase.
I know you could be feeling bit depressed as I had been there, but hey, given the weather, road condition and other environmental constraints toronto weather is going through currently, accidents seem to be very common..
Don't worry things will be all right soon.

You probably shouldn't have signed any paper agreeing to pay costs... if ur driving record so far is clean, and if you have pics of the huge pile of snow and if the lady was coming at higher speeds - unsafe under the conditions - then, may be you could have got away with a not-at-fault settlement. Insurance may still go up, but no so much.
I guess lots depends on what kind of bill you are looking at - from the lady as well as for your own car. If the door bend of her car is minor and if it is an older car (<5K), that probably can be fixed for 500-600. But it all depends on the lady - where she repairs, whether she includes some other repair also into the bill etc.
If I were you, I will call her today itself and ask for the repair estimate within the next couple of days. Earlier the better. If everything comes to less than 1K, may be you are better off paying it. If the numbers are not acceptable to you, then contact your insurance agency, otherwise pay it. Even your insurance policy will have a deductable (may be 500 or 1000) and for smaller bills, reporting to insurance won't get you any money (if below the deductable) and your premium will go high. In worst cases, she can claim some physical damage putting her out of work - even headaches!! - and claim damages from you. Worst come to worst, you can probably get the agreement signed nullified - as you were under duress.
Btw, by law, you are to report to MTO any accidents costing more than 1K in repair. If the lady reports and you don't, then, you can get into trouble later.
bottomline, it all comes down to numbers.
