My uncle is not a lawyer. He is an engineer. Perhaps his suggestions are based on inappropriate knowledge or information. I am sure you being an immigration lawyer, know better.
Sir, as you say that my case would first be assessed under the old rules and there is no requirement of IELTS in those rules. But then how would the visa officer be able to grant 9 points for English to me? Will he call me for an interview to judge language proficiency? Does that mean, all the applicants would be called for interview? Then what about waivers?
Like others I am also looking for a waiver and perhaps thats why my uncle suggested me to appear for IELTS. Please let me know your views on this. On what basis do they grant waivers?
Also please guide on how to obtain a job offer letter from an employer from Canada. As you know I am residing in India, is it possible for me to approach someone here or elsewhere through the net for such a letter?

That's the million dollar question. I suspect most files like yours will end up being assessed under new law or officer will simply assess under old law but waive interview. If pre-screening brings you 64 or more, waiver is most likely, especially given the new climate of moving on to new law.
Perhaps, you should take IELTS and forward to the embassy. It may influence the visa officer's decision.
