Ok, Reason why this judgement???? because all the witnesses brought up by persecution were proved to be lying. The star witness against Mr Bagri was an old Babbar Khalsa militant who was responsible for attack on Mr Rajiv Gandhi himself. So all persecution could get was a person who himself has been responsible for attack on indian leader. Defense asked him the question that why he was telling the truth now after all these years. To which he replied that because of his conscience. On this defence produced documents in the court which showed that the witness has been paid almost 4 hundred thousand dollars to testify against Mr Bagri and also the us immigration. Another thing the star witness against Mr Bagri had also murdered his own brother. At this the witness started to fumble and even RCMP agreed that money has been paid.

Now was the turn of star witness against Mr Malik. Well, there never was any evidence against Mr Malik other than his so called lover. Now that lady said that she loved him dearly and would never do anything that would harm him. Then why the hell was she testifying against him knowing that this could land him in jail for 25 years. She remebered many events that were like 15 years old but pretended memory loss of some that were like 4 or 5 years back. Ha......In the end defence was even able to prove that why she did all this .........because Mr Malik had fired her.

Now lets not delve into this trial anymore because it is a fact that there was virtually no evidence against defendents.

Most Glaring loopholes -
1. Mr Malik and Mr Bagri were not grilled at all. Usually persecution asks questions from accused but in this case accused were never brought to witness box. Strange ............huh.
2. Large amount of evidence was destroyed by CSIS. To which CSIS replied that it did so to protect its moles inside sikh militant network. But not long ago I had read interview of a CSIS officer in which he had said that the evidence was destroyed at the behest of some Indian politicians. Now if that is the case then we need to know all this. I followed this trial believing that Mr Malik and Mr Bagri were responsible for all this and could not wait for the day when they would be punished. I even attended about 70% of the hearing. I have read court documents extensively and all I can say that that there was no need for this trial. Persecution did not have any credible or worthwhile evidence. So why waste of so much money. RCMP says that it is still investigating....hopefully this time they would be able to get more credible evidence this time. Only God knows who did it? But there has been one silver lining to all this........I have started to appreciate canadian legal system. At least here judgements are given according to evidence and not on the mood on street. I might think that Mr Malik and Mr Bagri were responsible for this but that does not matter till the time there is no evidence.

Maybe Canada should outsource its criminal investigation to the CID. After all its defence is outsourced to the US.

You know on one hand I would like to "BELIEVE IN" the Justice system here .... because I am naive in presuming that the same system is here to protect me....... On the other hand ....... it disturbs me when I read more and more about this case ...... and NOW the verdict.

The whole affair of this case has been outrageous ..... right from the start ..... CSIS losing evidence .... officers destroying evidence .... a huge communication gap between the law enforcement agencies .... the judge's comments ... as to the witnesses not been credible etc etc
