Traffic ticket- Section 136(1)(a)

I got a traffic ticket for $110 under Section 136(1)(a), "Disobey stop sign- fail to stop". Not sure whether I really made this mistake. This is my first ticket. The cp explained about video record evidence.Really don't know pros and cons to fight or plead guilty? I am out of job now.

It is unfortunate that you received ticket while you are unemployed . May be its time to be more vigilant on stop sign . I learned it myself hard way .
If convicted you will be given an option to pay in installments if there is no source of income but please don't expect any sympathy from law makers .
It is very hard to fight Stop sign tickets in court due to video evidence present now a days .
If you wish you can hire a paralegal which will cost you upto 400 $ . Will it do any good is another question !
All he can do is keep postponing the hearing . Points are valid from the day of ticket for two years ( not from the day of conviction ) so postponing may buy you more time for points to be shown on ticket .
Plead guilty i- I know there will be plenty CD's here to give you moral lessons but do what you deem right as it carries quite a bit of repercussions.

Fight the Ticket . Always fight a ticket .Its you right and you only stand to gain.

Maybe your trial date is way late.
Maybe you do not get a disclosure timely.
Maybe the cop does not show up.

Worst case - you would be most likely provided a guilty plea bargain by the Prosecutor.

I do not see any added advantage of hiring a para legal ... Do it yourself . After you have gained the knowledge through the aforementioned website you would be able to fight your case more sincerely. After reading AG's post , he has some valid reason for hiring a para if he can postpone your hearing and IF the points are from the date of the ticket and not conviction .... though it makes sense that they should be from the date of conviction ... you might need to ascertain that .

if you have time you should fight the ticket, in worst case they would reduce the fine to half.

Most likely video will show where your car was when the light turned red. if you were half way through the signal, you can always give reasons supporting why you didn't stop.
If you started crossing signal after it turned red, then you are at fault and you are at the mercy of judge.

I am assuming this is for an all-way stop sign, not a red light.

My suggestion - if you have time to read/prepare and represent yourself - file a trial with an interpreter and officer present request. Avoid requesting a regular language interpreter like hindi/punjabi - but more ethnic language which may not be common. Also, please read the trial request form carefully as they intentionally highlight the option to not have the officer present.

Hiring a paralegal will be a waste of time and money if he/she cannot guarantee the result in your favor.

Don't worry about the video evidence - follow the websites provided by Fido above and in addition the following forum:

With no job currently, you have very little to lose. Take public transportation for all your filings and court appearances since parking costs are generally very high in those locations and you dont know how long you will be waiting.

Remember, pleading guilty even to a lesser charge with no demerit points MAY still cause your insurance to increase at renewal.

Its difficult to come to a complete stop when no one else around you seem to do it. Everyone is always in rush. I got honked by someone behind me for coming to a complete stop. But what we need to realize is that cops are not out to catch all of them, they probably will have some smaller quota to meet.

I try to get to a complete stop 50% of the time, the rest of the 50 is like a rolling stop like the car ahead of me. I do however make it a point to make complete stop around schools and know traps.

Good luck with the fight, its a logical choice.
