I think the fee only applies if the passport has not been surrendered for 90 days. At the risk of angering people on this thread, this is not very surprising to me and I am not against it. You lose Indian citizenship upon acquiring a foreign citizenship, and after that, it is illegal for you to use any document, such as a passport, that claims you are an Indian citizen. All Indian citizens acquiring another nationality almost certainly already know (through their friends or the Internet), that India does not allow multiple citizenship. Why is it then so hard to surrender their passport immediately?

I wouldn't be surprised if the reason they kept the passport is they thought that they could return to India with it.

First, there is no surrender of passport requirement by the Indian Govt. All they are asking is to get your passport stamped as cancelled and the passport(s) will be returned to you. This has been the procedure all along for years and IS THE new procedure as well.

The only two things they have changed is an additional fee of $175 to get the passport cancelled plus the 3 month rule to get this cancelled. The term "surrender" used by the govt is as farcical and false as the term "dual citizenship" used by the Indian govt on their websites.

If I understand the Chicago consulate website (the one that seems to have some info), the following might happen. I am an OCI and if at some point in the future, if I go to the Indian consulate to say, get a new OCI sticker on my new Cdn passport, I might be asked to pay $175 and get a surrender certificate before providing the OCI sticker (which is right now $25 or $20). Why should I pay that $175 when I have already had my passport cancelled or as some falsely term it, "surrendered" years ago?

I am with you on this.
Most of the Indo-Canadians or Indo-Americans are rich people (as per majority of CD's view) and would have no trouble ponying up the miniscule dough.
You should also note that the OCI fees had been previously reduced from CAD 400 to US $ 275 (to our advantage.
Most CD's got educated subsidzed in India, had availed reservation and were born and treated in govt hospitals for free . So why the hue and cry now for $ 175 for a genuine and valid service?
This $ 175 is a fees that comes for you to get a certificate that you are no longer an Indian citizen but that you will get all previlages as an NRI (OCI - as per some is a life long travel visa). NRI's get preference for education in educational institutions in India.
None of the CD's object to the $ 833 million wasted by cdn. govt. on G8/ G20.
Let us help India and do our part to lessen the defecit.
Though at this point, I donot even have the $ 175 for this service, I welcome it.

What about those who acquired citizenship few years before. Do they have to pay the fee also?

Yes, if you ever need to avail any services from an Indian consulate, like visa, OCI, PIO.
If someone has broken all ties with India and will never need to ever visit India again, then they could perhaps skip this fee.
They cannot force such people to get the "surrender" certificate.
