dear massod ji,
Recently my husband,s refugee case in canada is not accepted after going through two yeras of processing, let me know what other option he has to do. Either he can stay there or he has to go back to new york.
plz guide us what should we do now as we are going through a serious problem. What u think, and what will happen next if he is not leaving canada and is it easier to go back to America as during his stay in canada, his USA visa has been expired
what,s another possibilty
After a refugee claim is not accepted, the claimant [your husband] is on a removal route but before being removed there is a process called Pre-Removal Risk Assessment [PRRA]. This is basically another chance for a failed refugee claimant to ask immigration to take a last look at unfavourable circumstances in the claimant's country [against which the refugee claim was made] and let him/her stay in Canada.
Of course, before all this, your husband's lawyer will advise him on the possibility of a federal court appeal of the negative refugee decision.
Even a negative PRRA can be challenged in Federal Court.
He may go to the USA if he has a valid visa but may prove tricky given his current status in Canada.
Good luck!
