Thanks for your support guys.

I got my shipment back from the customs and I got the temporary 1 month apartment in Mississauga and will be moving there.

I will give another try at the border after 9/11, but this time I will try Detroit border instead of Niagara Falls.

B'cos I heard lot of desis travel to Detroit from Windor on H-1B visas, whereas Niagara Falls is a tourist attraction place. That guy who questioned me took 2 hours to search on INS for the rules. Initially he said I can't work again in US again on H-1B visa as I already worked for 6 years. But I mentioned him about the rule of staying out of the country for 1 full year and getting new H-1B term.

IMPORTANT POINTS:

1. He didn't stamped anything on visa.
2. They didn't asked me to sign anything.
3. They didn't gave me any document to me. Only thing they gave me is a document to Canadian Immigration indicating my denial of entry to US.
4. IMPORTANT: The immigration officer acted smart or dumb but stamped "ADMITTED" (the one usually they do when they allow into the country) in the passport, but later striked on it with "STAMPED IN ERROR". I don't know that's a genuine mistake or intentional. The hunch behind "intentional" b'cos that shows that I went to the Niagara border on that particular date, so that I can't go to another border immediately on the same date.


MY MISTAKES:

1. Going to border on the last day of my apartment lease date.
2. Going to the border during labor day weekend.
3. I should have gone first alone, instead of taking my family with me.
4. I shouldn't have sent the shipment first. (eventhough they haven't mentioned anything about I-94) For the shipping, I gave the passport copy and visa copy, that's what they asked me.
5. As I went to labor day weekend, I was not able to contact my US company and attorney immediately for immediate assistance.
6. Choosing the Niagara Falls instead of Detroit.

MY QUESTIONS:

Say if my next visit they approve my entry and give the I-94:

A. If I decided not to come back to Canada to take my stuff:

If I keep my stuff (only the important stuff like 5 suitcases and etc..) at storage, Can I ask some Canadian citizen to bring those stuff for me? Is it possible??

B. If I decided to come back to Canada to take my stuff :

Do I need to return the I-94 to Canadian folks? If I didn't return it and when I try to go back to USA with old I-94, will they allow me or Do I need to get the I-94 again ??? (with new rules from March, every PR needs a visa to visit US)

What's your advise?

Good news folks....

I got admitted into US. This time it was smooth. That previous officer was not there.

This time another officer was there. At first he called me and asked me "Sir, Do you had any trouble entering United States?". (He was holding printed document which I think prepared by the previous officer) I told him that I came on Aug 30th to that border post and my entry was denied b'cos that officer asked me bring more documents and I came here to show more documents.

He asked me show the documents. I showed him all the relevant documents like landlord documents, cable records and phone records of the whole year and car insurance records. He gone through each of document for about 15 min or so and then asked me wait in the lounge area.

He went inside to the Supervisor room and they spent like 30 min or so. Then another officer called my name and asked me to pay $6 fee for each I-94. :clap: The officer personally filled the I-94 form, which's different than when we enter US via air. (We fill the I-94 when we enter via air)

I told that officer that I got to go back to Canada, as I didn't bring any of my stuff. Then he stamped my I-94 with \"MULTIPLE ENTRY\" stamp. He told me not to surrender this I-94 to any Canadian folks till 2006. Told me to surrender the I-94 only in the case if I change the company or when I leave the US permanently.

We spent 2 hours in Buffalo and came back to home by night without any problems from Canadian side.

Good thing we did is following the attorney's advise by going to the same border post and going to the border on a weekday instead of weekend (in my case last time was Labor day long weekend). We were the only ones inside taking the I-94.

We are moving to US during this weekend or Monday.

I am very much relieved now.

I really appreciate your time, efforts and support during my 2 weeks agony. (During this period I lost 2 personal job interviews in NY and NJ)

It's a consulting firm. They gave me the offer and they went ahead and filed for the H-1B.

Once I got visa at local consulate, the company went after the clients for the projects. In simple words "I work at the client on behalf of the consulting firm."

I hope you understood.

Thank you and I already had 6 years of American experience. ;)

BTW, Y'day I moved successfully to USA but not without problems.

Eventhough last week I was allowed in and they gave me the I-94, they asked me to see the immigration folks again. :kaioken:

I spent one hour waiting there, then same questions were repeated. I showed the same damn proof of staying in Canada for one year. This time lady officer is good and saw the proof and asked few questions where I am going ..blah...That's it. Then I realized just like the message posted 'DesiboY', I am in their computer. So everytime I cross the border via Canada, they will ask same damn questions. :cuss:

Later I imported my car back into US (originally car bought in US and imported to Canada when I moved)
