Massood - Income tax clearance reqd?

Dear Massood

I have a query which I would like your advice on.

We will be immigrating to Toronto end July. The agent thru' whom we have purchased our tickets, have told us that we should get separate income tax clearance certificates for myself, spouse and our 3 kids (even thought they are minor). At the same time I have contacted my CA who says that the IT clearance certificates are no longer necessary. We wouldn't like to have any problem at the last minute at the airport.

Could you please let me know whether I need these certificates or not. I would appreciate your response

Not required. Tell your travel agent to stick to the travel industry and not venture into immigration law.

The requirement to have a Income Tax Clearance Certificate for travel abroad was deleted from the Indian Income Tax Act a few years back. Being a CA myself I checked the Income Tax Act before I came to Canada in October 2003 to ensure that I don't get into a wrangle at the airport. Not having satisfied with what I noted I even had this enquired with the Income Tax office and their reply it's no longer necessary.

Hate to tell you guys, but it was a travel agent's duty to do so. If not, you might say that it is not his duty to inform about visa requirements for a country to which a customer is buying a ticket for - which infact is an immigration matter.

I do not know now, but yes, I had toget this done when I came out of India. At that time you either had to get a income tax clearance to get immigration clearance at the airport - or prove to the immigration/passport authorities that you are a professional and get that immigration clearance requirement waived for a particular period (but not for employement outside India). This rule was made so that a person leaving the country should not be owing anything to the local tax authorities.

I was able to come out of India on the basis of temporary immigration clearance but had to fly back to get a final clearance to be able to take up a job in Singapore.

Only thing wrong about this question is that it should not have been addressed to Massood since it is an Indian requirement (or was one).
