I would recommend you to send a fax to the CHC London explaining that apparently there are doubts about you spouse's qualifications and that the Interviewer was not aware that you have submitted the original degree to London and due to which you could not show the degree to the Interviewer . Put the onus on them .
Furthermore mention that the degree / qualification is genuine and the CHC can get it verified .......
I am hoping that by this fax of yours .... take a copy and receipt of this ....... the CHC cannot make an arbitrary decision as in the case of law later this can go against them and in your favor that the CHC did not bother to verify despite your request and gave an arbitrary decision .
Also in the fax you might wish to request them to advise you that in case of a rejection (per the impression you got from the interviewer ) and in case of a doubt about the authenticity of the qualification where can you appeal and what would be the procedure .
This might just put them on the defensive - and they might reconsider everything - as for you you don't have anything to loose ... fax them before a decision is made .

Thanks Jona and Fido for your replies, appreciate your advice :-)
Yes I think I will send them a fax and you do have a point in which you said that it could work in our favor when we file the appeal... but does that make a difference to their decision?
Also if after getting the caips and I see that I score more than 69 points without adding my spouse degree points, can I ask them to just go with assessing the application only with my credentials and ignore my spouse certificate if they have doubts on it... is that possible?
Also in the worst case scenario would they refund the amount paid and is possible for me to re-apply?
I don't think they d agree to last 2 points . For one authenticity of documents and back ground checks are independent of points ....... they are validating details already submitted by you ..... and if they are not satisfied and have sufficient grounds for that , it amounts to mis representation and they can refuse an Application because of that alone .
I think while filing the Application it is understood that no processing fee will be refunded in case of a rejection . Thats a standard rule every where .
Sending a fax can help you both now and in future . For now they can say that they are in doubt since the Interviewer is not satisfied ........ but if you insist on a Degree Verification , authenticity will come out and nothing will be left for doubts ...... Time is of essence , do it quickly ----- if your fax reaches them after their decision , it may be too late .

I just visited our profile on CIC website and to our bad luck the status says ' Decision Made' I have however spoken to our consultant and they have asked me to give them complete details of questions asked etc in the interview and they will forward it to the lawyer. However I have told them that we should send a fax to CIC London office about the interview and the interviewer was not aware that my spouse original certificate is in London and we only had the photocopies to show him and explain the interview and say that we can surely provide verification of the certificate if they deem that fits in this situation....
Wut do you guys think are our chances are now after the status on our file is changed to 'Decision Made'??
It looks bleak to me :-(
I would suggest to still fax them . There s no harm . This can be used in your favor while you are appealing . Ask them as well whats the procedure for appealing .
It will just take longer but you should get it . Go as per your Agent and Lawyer's advice .

I spoke to my consultant now and have sent him a detailed email on the developments during the interview. He finds it hard to believe that they would reject my application on the sole reason of them not being satisfied on the authenticity of my spouse degree. He says that they cannot pass a judgement without authenticating the document as this can be sued in the courts for them to just disregard an application without checking it.
However the consultant has said lets wait for this week, we should get their reply and we don't know the outcome as yet, unless we have a reply from them we would not know wut they have decided and only after seeing their reply we can take an appropriate step. The consultant does not see any reason for my application to be rejected. He has however advised me to see if I can check with contacts in India if I could get a letter from the university confirming the authenticity of the degree, but I dont have anyone back in India who can do that(thats another thing) however will have to find a way to get the letter as the consultant said CIC would not contact the university and they would want us to do that and get the verification done. I argued that as its their doubt they should contact the university and clear it rather then asking us to provide a proof on the same... wut if we provide them the letter from the university and would they believe it?
