TN Visa Questions

Hi,
I am going to the TN Visa for first time. I have few questions :

1) I am planning to drive to Niagara Falls border early morning around 9 :00 am on my tentative joining date. Will this be an issue. I will be working in New York. Do they care when we plan to join. Actually I am not planning to join that day. I am coming back to Canada once I get my visa.

2) Is the TN Visa fees still $56.

3) My original offer letter has designation Technical Manager. I have not got the support letter yet from the employer. It will request for TN visa under computer system Analyst and my degree is in Electrical Engineering. Is this ok ?

4) Should we only drive ? Is it possible to take a bus and get TN Visa. Do they take very long time ?

5) I am taking the original and copy of following
1) Degree Certificate and consolidated mark sheet
2) Experience letters of last three employers
3) TN Visa Employer letter
I have only the copy of the degree evaluation. My employer refused to send the original.

1. Your work start date need not be same as the TN visit date. Clearly, work start date cannot be before TN, but can be after. Regardless, your validity will begin from the day you apply.

2. Yes - $50 for TN plus $6 for I-94.

3. What does the "TN occupation list" require in terms of degree? That's what will dictate eligibility.

4. Driving is more convenient. The bus will not wait for you. TN might take 15 min or 2 hours depending on the officer's availability, your application, crowd, etc.

5. Technically, you only need the TN employment letter from your employer, your degree certs and passport (all originals). Everything else is fluff. If you have a straightforward, non-frivolous application, that's all you need. But, it doesn't hurt to take more.

Can't comment on why your employer would hold the original degree evaluation. I believe, if you have a non-US or Cdn degree, you will need an original degree evaluation.

I would really want that you are well prepared for the first time you go in for your TN Visa.I have a mechanical engineering degree and went with a mechanical engineering job description but was refused the first time as the TN officer concurred that the job description was not a good match with the Department of Labour job descriptions for the standard duties a mechanical engineer should be performing.My only concern is that if you are refused the first time it may be recorded and affect subsequent applications.

Please spend a $1000 more and consult with a TN attorney who will give you professional advice and you can be prepared that day.There is no point in making a few assumptions and taking something to chance.Let us play by the rules as far as possible.

The TN officer did review my original letter of equivalency that was issued by UToronto even though I had an MS degree from the US.

The last thing I want for you is driving back on the QEW after waiting for 5 hours at Buffalo.That was my experience the first time.

TN officers probably love the title computer analyst and management analyst and degrees that do not go with that.

One more question: Should we just give them the employer letter or Do they also want to see the actual offer letter ?

This is what is listed as requirements for a Computer System Analyst under TN occupation list:

Computer Systems Analyst
Baccalaureate or Licenciatura degree; or Post-Secondary Diploma or Post Secondary Certificate and three years' experience.
-------------------------------------------

Since you have a bachelor's degree and assuming you also have 3 yrs of experience, you should be ok.

Since the occupation requires you to prove your experience, I'll restate what I previously stated and say you'll also need verifiable documents to prove your experience.
