Loss of PR status- appeal or reapply ?

My husband and I married in Canada, me sponsoring him and he was a permanent resident in 2002, but we had to come back to Turkey for a judicial court (related with the partnership of our only house) and the case is still being carried. My husband is following the case, and it has started only 15 days after we arrived in Turkey (in 2002) and still not finalized for almost 7 years. Our plan was to sell the house, our only tie to Turkey and settle in Canada for good. But during this time my husband lost his status - probably. For me, I lived in Canada in 2000-2002 and after that entered again in 2005 not to loose my status at least as we always planned to go back and I am a PR card holder with an expiry date of February 2010. After I obtained my PR card I could only stay in Canada for 8 months as my husband had to be in Turkey and I had to help my brother with the family business as he was financially in crisis. After that I got pregnant consecutively, could not go back to Canada and now have two babies,which need fulltime care. I have no relativest there to help me while I am working, therefore I had to wait for my husband's case - still not finalized. Evenif I do come to Canada as of today, 8 months plus 11 months March 2009 to Jan 2010), total will make 19 months which means I already lost my status- I think.

But when I asked canadian embassy in turkey and they told me that I still have a validpr card and can travel to canada and my husband should apply for a travel document.

Do we have to reapply for immigration or is there any possibility that we can regain our status by explaining our reasons why we stayed in Turkey for so long? How will the appeal process work ? As I have 2 babies it is hard for us to come to canada blindly, so I will really appreciate if you can guide us.

u have a valid PR---U can travel
your husband and kids can apply for travel document
After they get the travel document, all of u can travel together
The officer at port of entry will decide your case whether to allow you on humanitarian grounds or refer you to IMM REVIEW BOARD.

You do have a Valid PR card. You can travel to Canada.

Your Husband can travel if and when he gets a travel permit.

Your two children who were born in Turkey?, will have to be sponsored by you from within Canada. When their sponsorship gets completed and their Passports get stamped, they can be brought by your husband or by you at that time. They will give you both ample time to prepare and do the traveling. While the process is going through, it is advisable that you to stay here till the process gets completed. Then proceed to pick them up.

You will have to decide who is going to be Mr.Mom.

Yes my children are born in Turkey. If I do get a tourist visa for them, maybe they can travel with me? They are very small, one 7 of them months old, elder 22 months old!! So my husband cannot take care of them alone :(
If the officer lets us in on humanitarian grounds, is there a possibility that I will be deported when the pr is over in Feb 2010 ?
But above all, even if they let me in, I do not fulfill the residency obligations thus I will not be able to sponsor the children? ?? Besides I sponsored my husband also, so he will not be able to sponsor them either.
I am so confused what to do..:cry:

hi everyone,

actually i am mother of 18yr old baby son. i want to sponsor him but sponsor can't be done from pakistan. so i hav edecided to go back to canada and sponsor my son (it is the toughest decision of my life).
but can anyone tell me how long will it take ?
plus do u think i should apply for a visit visa?
or shall i go there and sponsor him first and then apply for visit visa?
so confused and really depresseda si can't see in my sons eyes. and really hardened my heart for his future.
