Maintaining Spouse PR Status while outside Canada

This question is directed at folks who may have faced this situation.
Scenario:
Husband, child :- Canadian Passport holders
Wife :- Canadian PR holder

Can the Wife maintain her PR status while staying outside Canada by applying for a Returning Resident permit with the specific clause of accompanying Canadian Citizens.

Both husband and wife file Canadian Tax returns (albeit Non-resident taxes) and also contribute to their RRSP and RESP accounts every year.

May I ask what do you mean by "prove it"? Does it mean prove that she is the spouse...or..?

They may ask that you were staying together ( like she was with you outside canada as you had a job there ) .
something to show that you were together like joint bank account or rental agreement or house etc .

Sant, they have a joint bank account/RRSp account in Canada.



Joint bank account in canada doesnt mean anything .
wife should be able to prove that she was ACOMPANYING her husband while she was out of canada .
it has to be proved that in last 5 years she was in canada or accompanying her spouse if outside canada for at least 3 years .

for example :
In last 5 years
husband was working in US for 5 years and he is citizen of canada .
wife is PR and moved in with her husband in US but after a year she moved to INDIA for rest 4 years , so tchnically she has gathered 1 year ( 365 days ) out of 3 three years required for PR purposes.

but if she was together with her husband in US all of these 5 years then she can maintain her PR .
