Hallo my Seniors,
I would like to know that if one has not been able to stay for 2 years in canada out of the 5 years validity of the PR card but is in canada from the last six months of expiry of the PR card, can one continue to live and work in canada . Also can one apply for renewal of the PR card in such a case
regards,
Akhildua
BOSS--your case looks very interesting.Perfect case study for MBA. Can you tell us how u managed to enter Canada even though u did not stay for two years out of 5 years. What did u tell at the port of entry and did they issue any removal order or did they tell u to appear before a judge when u last entered canada. Many of our friends including me are in the similar situation like yours. As far as your case is concerned ,I feel if you are already in canada--then nothing stops you from working and staying here. The problem starts only when u go out of the country. May be others can tell u in detail. please narrate your story in detail so that all others in similar situation can benefit from your experience. Thanks in advance
Dear Lucky,
My PR has not expried yet. I am just asking as I may not be able to complete 2 years out of the 5 years block.
Thus if one can stay and work under the circumstances, I will take my ime till i am comfortble to go there --- by getting a good job. Getting a reasonable job is not easy in canada as i assessed.
Else, I will have to go and try my fate

Akhil
Dear Brothers/ Sisters,
Please, I urgently need your advise on my following query:-
Me ( as a principal immigrant) and my family immigrated to canada in 2005. My family is here while I had been coming in and going out of canada till now. We complete our 5 years of Permanent Residency in April' 2010. I have stayed in Canada for only 120 days till now. I want to know how would I be allowed to work and live in canada after april 2010 if I am not able to complete my 730 days in Canada till then ( expiry of my PR validity). Please advise.
Freddi: You have been advising so many people on the immigration questions, Please advise me as well asap
regards,
Akhil
The rule states very clearly that your PR obligation is 2/last 5 years residence in Canada .... so come April 2010 (assuming you continue staying here till then ) you would fall 1 month short (since you have spent 4 months ) of the 2 year period ..........
Technically you might be questioned when you send your papers for PR renewal ......... leaving your reasons to be discreted upon by the CHC .
Personally I hope they might allow a grace of 1-2 months if you stay continuously till then but I would consider it to be a careless mistake having missed your PR obligation so close .
On a side note - when was the last time you entered Canada and at the port did they ask any questions with regards to your PR oblidations or your stay out of Canada .

1> Work
U are allowed to continue to work even after ur PR expires.. Only thing is do not leave the country u may have a very hard time returning..
2> Renewal
U should apply for renewal may be after u complete 2 years of residency..
Most pobably they will send u to a immigration judge and who will grant ur new PR on considerations that u have actively settlled.
This renewal process can take upto 1 year for a complex case like urs..
