Hello,
I am just become a Landed Immigrant. I have situation like this:
I live & working in NY, USA on H1B (TEMP WORK VISA 3 YRS VALIDITY ).
I just got my PR papers. I just landed to canada for my immigration landing process and I will get my PR card in 6-8 weeks.
I am going back in 1-2 months to NY,USA will continue my job.
NOW MY QUESTION IS: AS RIGHT NOW I AM HERE IN CANADA, AND SOMEONE SUGGESTED THAT I SHUD NOT APPLY SIN CARD. COZ IF I APPLY SIN CARD AND THEN IF I WILL GO BACK TO USA AND WORK THERE THEN MY USA INCOME WILL BE CONSIDERED AS TAXABLE INCOME FOR CANADA, EVENTHOUGH I PAY TAXES ON MY INCOME IN USA.
CAN ANYONE SHARE THEIR VIEWS/INFOMRATION/KNOWLEDGE ON THIS ?
IF THIS INFORMATION IS CORRECT. THEN HOW DOES IT AFFECT MY CITIZENSHIP WHEN I FULLY SATTLED IN CANADA AND WILL BE ELLIGIBLE AND APPLY AFTER TOTAL STAY OF 3 YRS. ??
THANKS
BHARAT
This has been discussed before. If you are not physically present in Canada after being a PR and have no ties (SIN, bank acct etc.) I guess you can get away without declaring your world (US income). However you may want to read up on being a deemed resident, non-resident etc.
Anyway, this should not have any effect on when you apply for citizenship as that is based on physical presence, though they might ask you why you continued to live in the US after becoming a PR.
When you get your PR and have the card on person, your obligation is to be here in Canada for two good years out of Five. That will keep your status as a Canadian Permanent Resident.
As regards Taxes, you pay taxes in the USA. That completes that question.
If you pay taxes here or not, your absence out of Canada is just that. Nothing qualifies you, other than your physical presence, or working there for a CANADIAN Company, that has Head Offices here.
As posted above, it has been discussed here and so do not obtain a SIN card. Do not open a Bank account. Do not buy a Car, Do not obtain a Driver's License... There are a few more, you can search for that thread and get clear cut details as to what not to do.
As regards paying taxes to Canada, you can skip that till you land here and settle down permanently. Keep your pay stubs and tax filings in the USA. They might come handy forty years from now?!
If you want to delve deeper into it. do your search and Look for DTAA in the Government of Canada Revenue department website. (CRA). They are called Canada Revenue Agency.
You have lots of time to do the research.
Freddie.

I don't see DTAA in the Canadian website but in the Indian one. So above are the links that will take you to them. Also Contact CRA for their IT Bulletins. F
