I have applied for my wife family for dependent category. My wife's brother is over age 24 but his study is continous , but get failed two time. WIll he get visa as a dependet of his parents?

hard to tell. This issue always brings up fierce arguments between Immigration department lawyers and lawyers representing people like you.

We argue that the student has to simply attend a recognised educational institution. [quantitative argument]

Immigration try to justify their refusals by arguing that the attendance should be qualitative as well, i.e the student should always pass his/her exams.

So far, I've won 75% of similar cases. Please note that every case should be considered on its own particular set of facts.
