Hi,
This is my first post here, and I just want to say hats off to the Canadian Desi community. I have been a lurker for 7+ years now, and have gleaned a lot of information from some very informative posters.
Let me get to the issue quickly:
I need to sell my house in Canada. Unfortunately, the co-owner is in Bangalore, India. I wish to create a Power of Attorney with the specific power to sell this Canadian house. The problem is that I do not know whether I should create a POA in Indian format or Canadian format.
If I were to create a Canadian POA, and send it to him, can he sign the papers using an Indian notary/witness? Would it then be legal here in Canada?
2nd question: Are there any other alternatives to POA?
And finally, last question: Do I need to pay a lawyer for this? I know that I can easily get the POA form off of the internet.
This is extremely urgent. I thank you in advance for helping me out. Thank you thank you thank you!
Let him execute Power of Attorney in India with two witnesses and Notary and send you the same.
That is legally valid in Canada for your purpose.
