TN to H1B

My TN expires on End of Feb./2012
My employer had applied for H1B for change of status(I-129) on Sept. 30th/2011 and still it's in initial review process...
If I don't get H1B approval before my TN expires..
Do I have to renew TN? or wait for H1B and continue working with same employer or leave US?

There is a rule where you can continue or begin employment on H1 as soon as you receive the "Notice of Receipt". I believe this rule still applies. If your employer has that, then you can continue. I don't believe you can apply for TN when another non-immigrant petition is pending decision.

-- He can apply for TN if his H1 is not approved. But the TN gets killed as soon as the H1 gets approved.

The moment your H1 is denied, you are out of status and cannot work. But if you have TN, then you can continue working.
