Hi group

My TN application was rejected this morrning at Pearson airport and I am looking for some guidence from the forum members regarding next steps. Here is my background

Education : B. Com, M.Com and Post graduate diploma in business management. All from India and these degrees have been evaluated for equivalency by U of T.

Work experience : 13 years of business analysis experience in financial services industry.

Job offer : I got a job offer from a mutual fund company in wisconsin as a contract business analyst for 1 year and the company gave me a TN sponsor letter under Computer Systems Analyst job category.

I brought all the relevant documents (TN letter, degree certs & a copy of my resume) to Pearson airport this morning and the officer who handled my application said that I have all the proper documentation needed but rejected my application saying that my education does not relate to the job I am applyong the visa for.

I need some assistance from the forum members as to the options I have to further pursue this opportunity. I am going to talk to the company who offered me this position and see if they can help in anyway.

Can you pls let me know how I shoudl proceed further.

Sorry to hear that. Looking through the occupation list, the requirements for a CSA is a bachelor's degree.

I am assuming B.Com means Bach of Commerce degree and it's a 3 year degree. If so, the only reason I can think of is the fact the degree is not a computer systems or related degree. Or maybe their definition of Bach degree is a 4 year degree.

As you indicated, talk to the employer and see if they can offer any alternatives. Unfortunately the occupations of CSA and Management Consultant gets scrutinized deeper.

Do you happen to know any TN lawyer I can contact in this regard.

B.Com is Bachelor of Commerce and M.Com is Master of commerce and I got the equivalency from U of T that states that it is equivalent to a bachelor's degree in North america. The officer said that it is because the degree is not related to computers.

Anyway, I think I should talk to a TN lawyer abt it.

Sorry. I don't have any lawyers that I can recommend. The two times I have obtained TN was through the employers' legal group that only represent the employers' clients.

I am sure there are tons of such lawyers available. The above guys offer free evaluation and you may be able to take advantage of that before you decide further.

Considering your contract is just 1 year, I would be careful how much money I would spend for lawyers.

-- Lawyers won't do any good - just take the money. The degree should be related to your job category, this is the very basic TN requirement. Unless you meet this requirement, no one will be able to help you. Your only way out is to get a job that is relevant to your educational qualification.

We have an example where the applicant is an Electrical Engineer and got the TN Visa successfully for a Computer Systems Analyst job ?

If the coursework in the engineering program is related to the job description (and if this falls in the TN category/description), then it is possible.

In this case, I do not know how the commerce degrees relate to the computer system analyst job title.
