CIO refused my FSW application: can I reappeal???

HI folks,

I had sent my application to CIO under FSW category with AEO .Today I have received an email from CIO saying that my application for PR has been refused. Here is the email that I received :

"I have now completed the assessment of your application for a permanent resident visa as a skilled worker. I have determined that you do not meet the requirements for immigration to Canada.



Subsection 75(2) of the Immigration and Refugee Protection Regulations states that a foreign national is a skilled worker if:

a) within the ten years preceding the date of their application for a permanent resident visa, they, have at least one year of continuous full-time (37.5 hours/week) employment experience as described in subsection 80(7), or the equivalent in continuous part-time employment in one or more occupations, other than a restricted occupation, that are listed in Skill Type 0 Management Occupations or Skill Levels A or B of the National Occupational Classification matrix;



b) during that period of employment they performed the actions described in the lead statement for the occupation as set out in the occupational descriptions of the National Occupational Classification; and



c) during that period of employment they performed a substantial number of the main duties of the occupation as set out in the occupational descriptions of the National Occupational Classification, including all of the essential duties.



I am not satisfied that you meet part B and C of these requirements because there are no main duties or responsibilities listed on your letters of employment and the letters do not indicate if these were paid periods of employment."

As far as I am understanding, looks like they were looking for my Appointment letters and salary certificates of my past jobs which i didnt send with the package, thinking that work experience certificate would be enough to claim points and Work Exp certicates are just mentioning my period of working in that the companies but not the duties and salary.

I am wondering if i can send my appointment letters and salary certificates to CIO and ask them to reconsider my application with the supporting document.....Do u think it is possible to do? if so, then how can i go for it???? Please advice me ASAP....

you can try to submit documents with reconsideration request. No harm in trying before reapplying.

DO NOT just re-submit same documents...
It seems like your work experience is not under approved NOC.
If it was under approved NOC, provide proper letter of employement explaining your job duties that matches with NOC, also provide proofs that your employment was PAID.

CIC does not assume anything, you have to provide proofs for all of their requirements.

Thanks..I guess you are right about sending request for reconsideration But I dont have their Fax no or contact no or email id.could u please give me so that i can fax or email the request with the documents before they refund the fees back to me?

I am affraid, they will not accept any communications via phone or email..
if you can find out correct fax number, you can give it a try...not sure if you will succeed or not.
