Hi All,

We are Canadian citizens and we were travelling through US, when my wife got sick and unexpected gave birth to our son three weeks earlier than the expected date. We have requested the Birth certificate but it takes 6-8 weeks. We want to come home to Canada, but we don’t have the birth certificate yet. What other type of documents or verification we need to enter Canada. It is very difficult for us to wait here for 6-8 weeks to get birth certificate as I have to get back to home and work.

Did you check with Canadian Consulate in US. They are good in responding and or picking up phones. You can go near one and check with them.

I contacted both consulate and Canada Border Services Agency but not getting any clear reply. One says contact other and vice versa.

So not sure what to do....

if the child is born in US , then he/she would have us birth certificate isn't it?

based on that birth certificate you can travel to canada I guess. and once you are in there you can resolve other issues from inside.

thats what I think, but not sure.

First and the foremost: A record of a birth to two of you with specific names and address and if possible reference to the Passport that you are carrying on you, must be made to the Canadian High Commission there near by. In it it should mention the Name, if provided there at the time of birth and the other details as recorded in the hospital documents, with the Signature of the Doctor in Attendance or the Nurse at birth and any parties that were present at the time of the birth.

A statement from the hospital, same as you submitted for the Birth Certificate, with a copy of the application made to acquire one and the fees paid to obtain it and the copy of the receipt or the original if available.

Any pictures taken at the hospital together with the Doctors and Nurse could also be attached as secondary proof of the event. Also the monies paid for the stay at that institution to augment your proof of birth there.

With all of the above and with the proper fees that are due, you approach the Canadian Embassy there nearby, wherever you are, make a declaration to them that there was a birth to two of you while traveling abroad. Please keep extra copies of the same. (Three at the least.)

Also ask the Doctor at that Hospital to make a record of birth to the two of you to his State Representative there where he lives, for making the kids life a lot simpler at a later date. He can speed up the birth Certificate for the child as he needs that document to travel to Canada. (as the child and the Parents are all also Canadians.) (More on it in the ensuing years.) There is a ONE time Travel document issued to a US born Baby too. You can get the details through the Doctor and his State representative. Explore this possibility too while he is submitting his birth records to the Senator. Please see which one you can acquire the soonest.

With this REPORT of Birth abroad and the fees required to obtain a travel document, they will provide you with a one time travel document to cross the border and I am sure they could do it before the 23 evening 16:00 hrs, if you are there by Monday Morning. (21st Dec) , failing which, I am sure, on the 28th of December 2009 for the travels for three of you. They may insist upon having photos of the child for the issue of the document. So, Please see a professional photographer to facilitate the same. Take and keep copies for records.

**** Where a permanent resident travels on either of these documents, the permanent resident must be in possession of a Permanent Resident Card. Alternatively, the document must be endorsed with a permanent resident travel document (same format as a visa), issued at a Canadian mission abroad*****

**Single journey travel document
The single journey travel document (SJTD) [see Appendix II, item 5. (a)] serves to facilitate oneway travel to Canada under limited and exceptional circumstances to those who are otherwise unable to obtain a prescribed travel document (i.e. passport). 30 Subsection 50(2) of the IRPR. **

*** The following documents are evidence of U.S. citizenship. They are not intended for international travel and do not comply with international travel document standards. They should be supported by other recent U.S. government-issued photo identifi cation. The passenger must satisfy document screening
personnel that the person is the rightful holder.
U.S. certificate of citizenship.
U.S. certificate of naturalization.
U.S. certification of birth abroad or consular report of birth abroad.
U.S. birth certificate. ***

If for any reason you have to leave behind the child and the Mother there, please make sure you leave a letter with permission for her to travel with the baby and notarized by you with your Passport as a support document so that she can travel with the child to Canada.

The ONUS is on YOU to report the BIRTH of a CHILD Abroad, in a format approved by the Canadian Mission Abroad.

Assuming the birth occured at a hospital:

1. The hospital will issue a "Record of Live Birth". This will carry baby's name, parents' name and parents' resident country/city. You do not have to make any specific requests for this record. In most cases, it is part of the hospital discharge procedure.

2. Use that to cross the border (assuming you are driving). Since you are Cdn citizens, the baby is a Cdn citizen (see my next post), hence will be allowed without hindrance.

At most, you will be asked to explain the circumstances around the birth and I am sure you can explain what you stated in your post.

Once you are home, apply for proof of Cdn citizenship for the child.

The city issue birth certificate normally is available 10 to 30 days after the hospital forwards the records. You may have to call or possibly visit the city office to obtain any number of originals at that time. Usually, one or 2 originals are free and then there is a nominal fee.

The steps tend to be as follows:

FOR USA:

1. Record of live birth
2. US birth certificate (required to get US social security number unless applied during live birth record at hospital)
3. US Social security number (required to get US passport)
4. US passport

For Canada:

1. Record of live birth
2. US birth certificate
3. Proof of Cdn citizenship (you may need birth certs to get this)
4. Cdn passport, SIN number, health card, etc
