I alongwith my wife and childerns acquired the PR status in 2003. While my wife and childrens have met the residency requirements of 2 years, I could met the residency requirements due to my business as well as family commitments in India. Now I seeks advice on the following:
(a.) Whether my wife can sponsor me, if yes, what are chances that I will regain PR status. How much time,the entire process will be taken.
(b.) Whether I may be able to get the visitors' visa to visit my family in Canada. In this connection, I clarify that during my PR status I have regularly visiting Canada to meet my family. Is there is any possibility that Immigartion Officer may deny visitors' visa.
I need the advices of Canadian Desi in the matter.
my wife also could not fulfil her residency requirement due to her parents health back home but her PR card is valid till May/25 2009. I am also thinking of sponsoring her again. I also want to know ;
(a) shud she make one last try before May/25 2009 and see what the officers at the port of entry tell her ?
(b) shud I also try for her visitors visa first and then apply for her sponsorship ?
Can anybody tell us his story who has gone through the similar type of situation. All suggestions are welcome
For both of you guys i would suggest the following
1>Return to Canada as soon as u or ur spouse can..
Now u have 2 choices..
2> Tell the truth at the port of entry about ur absence
Mostly likely they will allow u to enter since u have family and all there, and they could initiate a removal process..
Once u get letter with court appearence dates for the removal process hire a immigration lawyer and appeal on Humanitarian grounds. U have a more than likely chance it will get approved, since ur spous has completed the residency requirements..
If they dont say anything about the removal process during ur entry intervierw at the port of entry u should just apply for renewal of PR..
At this point u may have to appear before judge who will say yes or no.. (This can take upto 18 months )
Or
2> Lie at the border and tell them u had gone for a short period.
If u get question u can always say u returned by land from US.. But here also they can check for US entry stamp and find out the truth..
What happens if u lie is unknown.. I wouldnt recommend it as even ur citizenship can be revoked if ur paperwork is based on a lie..
Lastly
If u cannot return as ur PR has already expired then more than likely visitor visa will not be issued to u..
Ur spouse can apply for spousal sponsorship.. The timeline for the same is 3-18 months.. And for complex cases like urs it could be more in the 18 month time line..

In this connection we seek your views whether I may be able to get the visitors'visa considering the fact that presently I am working in one of the large bank in India and occupying very senior position with annual salary of approx. CAN $ 125K. The Bank will also confirm sanction of leave for my stay in Canada.
Pl. advice me holding of permanent job in India with grant of leave will help my in getting visitors' visa. In this connection,I further clarify that I have not intention to stay back in Canada on visitors visa and I will also get the confirmed ticket for return journey. My intention is to meet my family on half yearly rests.
I dont think ur job will matter in getting a visitors visa.. The visitors visa will be granted based on what are the chance of u returning back .. and u will fall in the high risk category as a person who will stay back illegally..
Mind u this is just an opinion from a person who is not a immigration expert ,
I speak based on my personal experiences and knowledge from reading immigration boards
So there is always no harm in trying.. At the most it will get rejected..
Another alternative is U could try for a US visa and then meet ur family in the US near one of the bordering states...
