Here is my take: You spend a few years here and study. Then you work for an year on a work permit. The time you have spent here is in your favour. You don't know how much it benefits you and your family. You don't know that your family can ride on your coat tails and enter into Canada in a very comfortable way, when YOU facilitate their entry in, through this application, faster than any other means.
When you defer their entry, by accident or by design and want to start this process once again at a later date, you have not only failed to use it when the doors were open, you will be going through the same process all over again and the anguish and the time spent is a creation of your own, you don't know what you are doing then and why you missed that one golden opportunity, which is currently staring at you, in your face, begging to take it. You are adamant in your behaviour by rejecting it. All of this is your own making.
That is why I said that I respect your views and decisions that you make. You also know that it suits you.

I totally hear you and understand that it is in my best that I apply for PR for myself and my spouse together. I totally understand and know that this is the BEST option to choose. But there are some reasons (personal ofcourse) that I am going for this option i am going for.

Hi there,
#4 is easy to answer as you are currently on a work permit and you can provide the details about the work permit.
Is this job renewable and if your current employer will 'Renew' it for a like period and if they will provide you with a letter offering permanent employment, If yes, then get it and attach the same. Also there are jobs that need no clearance, and if so, can you obtain one by yourself? Now find the ones that do not need labour certification.
#3 You will have to provide the Immigration department with a job offer from an employer who needs your services, based upon your current skills and educational background.
#8 You know the type of work you have undertaken and about the experience from the previous employement here in Canada. Do not quote the current job as you are providing them the details. You might have worked during the summer time or supplemented your income during your stay here, either through the educational institutions or with other employers, with Immigration approval. If so, then, provide them with the details here. Also if you have filed the Income tax returns, the NOA or the copies of them.
Please remember that they already have these details and it is for you to provide the same as truthfully as you can and substantiate them. All of these will fall under the #11, starting from the top with the current occupation. If they are part time work and if they were concurrent, then, fill the first one that was started early. And If the starting dates are the same, then with the order of importance of the job, to YOU.
Everyone is a 'Newbie' here and we are not certified immigrantion consultants. We help you to our best. Most of the times it is sufficient. There are Immigrant help services that are available to all of you and not knowing the closest one to your location there in BC, I will request you to search the locale that you are familier with and provide us with the details too. Yupp, Q4. is easy. i will tick yes as i am on a work permit and i will attach a copy of it along with my application.
As i had mentioned before that I plan to apply for PR and then leave canada to work on the project in Europe and meanwhile when my PR comes next year same time in May/june 2009 I intend to return to Canada.
So i will be quitting my present job once my employer send me the work permit to work in EU - european union.
In that case for #3. I guess it will be no as I do not have any offer of employment in my hand at present which is approved by HRSDC. If i had stayed in my present job I would have applied for LMO but not as of now as I am moving out of Canada soon.
#8. I worked in toronto before moving to Vancouver. i didnt work in summer or any other income. my course was just an 8 months course.
I do have my Employment record, letter of job offer/appointment letter from previous employer in toronto. Shall I attach a copy of that as well?
I did file tax for both the years....2006 and 2007. I will attach a copy of that as well.

Another thing...When you call CIC call center here in Canada they say that they CANNOT/ WILL NOT HELP in giving any answers to queries related to PR application. They ask us to call Buffalo office. Buffalo office doesnt entertain any telephonic enquiries. WHen you email them they say give us the File no. of your PR application! I mean how on earth one is supposed to get answers for their queries? What is it ? some kind of diplomatic official circus? Merry-go-round?
they say they need skilled immigrants. Really? are they honest about giving enough support and help to those skilled professionals? Or they just want immigrants to come and do all the hard labour jobs? I wish if i could ask this directly to a immigration minister/official!

Underneath the same question, they are providing you with a chance and with boxes that you can tick, to tell them about your proficiency, depending upon a level at which you can Speak, (Understand) Listen, Read and Write. You please choose the appropriate boxes suitable to your level that you place yourself.
Now comes the crunch: In Question # 6, they are asking you to provide them with a PROOF of such a test. Now you will have to come up with one. Can you?

So, we are back to square ONE. I did ask you if you have a job offer here in Canada? Is the employer who is hiring you, needs your service and skills in Europe? So, you do not have an ongoing job offer here in Canada.
Now you know how to fill out a Schedule 3, Economic Class, Federal Skilled Worker's Application.
Now go and find an Employer and get a job offer here in Canada, if you want to immigrate into Canada as a PR. Then work for him here.

Regarding the L.M.O. thing you have mentioned. I want to know that can't someone who is working in Canada on a post graduate work permit apply for PR?
I mean I am leaving Canada and apply for PR before leaving.
I think you got it wrong. I am NOR working for a Canadian Employer who requires my services in Europe. Its all together different. I am leaving for europe and working for a European employer and for that I require the work permit to work in Europe.
So does it really matter if i have a L.M.O. or not? Can't i just apply for PR based on my points?
When i will be working outside of Canada after having my PR applied and that too for a non-canadian employer do i still require a L.M.O?
The idea was, to apply for PR, let the ball rolling...processing would take a year or so and I would come back to canada once my PR comes and meanwhile I will finish my project/job in Europe.
I hope i have cleared the confusion about the LMO thingy.

Hi again,
You completed your studies. You asked for a work permit for an year to gain Canadian Experience and you are currently employed with an employer here. If you have ongoing employment with him or with any other employer, you can renew your work permit/L.M.O. and apply for Immigration into Canada, from within and send your P.R. application.
If your work permit expires in the next few months and you apply now and leave whenever you feel that you are free from the present employer, you are leaving Canada. If you have a confirmed job and you are working for an employer, then you are here and inside Canada.
When your Work Permit gets over and you leave Canada, in my opinion, you are abandoning your status here and the application that you filed from within Canada.
If you can extend the Labor Market Opinion through your current employer or through another one that is suitable to you, then, your stay here will be good for the extended period. Hence the 'renewal' and or the 'extension'. That provides you with a 'legal status'.
While your application is in process, unless you have a multiple entry visa to travel in and out of Canada, for whatever reason that you want to, your return is not assured, nor your re-entry.
In your current instance, when your work permit expires, one that you have for the Canadian Experience, after your study, your status here, as a student or as a worker on a work permit is over. After that your status is termed as an illegal immigrant. To over come this, you can apply for a PR, as you are intending to do it now. It is the continuation of your stay within Canada, is what I would like to ask you to safeguard, with another L.M.O. or an extension of the current work permit.
The question once again is: Can you do that?? If you can, then, you are providing yourself with the additional time that you will need to secure the P.R.
And if you do, No One will doubt you or question your stay here. In the additional time that you get, there is a possibility that your PR Status might come through. After that you have to fulfill two years our of five.
My previous letter to you is based upon my understanding of the current procedures. My request to you is based upon this current procedure. I hope I made this clearer to you with this explanation. There is no misunderstanding in this.
