I got my PR card in Jul 2003. at that time i stayed in canada for 1.5 mths and went back to india to wind up my business. Again i came back to Canada in Aug 2005 and stayed till Jan 2007 and went back to india for 3 months ( Came back in April 2007) and i moved to USA in Sep 2007 and since then i am in USA. As per my calculation i am short of 3 months for my 2 years stay in Canada as my PR card expires in Jul 2008. If i want to continue my PR card i have to re-enter Canada latest by APR 2008.

will there be any problem when i Re-enter canada in Apr 2008?

I gave birth to my child in Nov 2007 in US and i want to move back to canada with my baby? will my baby`s american citizenship creat any problem for me?

FOR PR CARD:
Please return back in April of this year and apply for renewal 30 days prior to the expiry of the current PR Card.

There are other important items to take care in between.

As regards the Baby's Entry, according to a representative of the Citizenship and Immigration Canada Call Center, as a Permanent Resident you will have to bring your child to Canada on a visitor's Visa and then sponsor him/her within Canada.

You will also need the travel documents for the Baby. Apply for the Passport for the Baby there in the United States. Also have the birth certificate and other materials, such as hospital records, finger prints, foot impressions, hospital bills etc., at the Port of Entry if they ask for them.

Also you must be in Canada with the baby to sponsor your baby. You need to bring your child into Canada with you as a visitor. Contact the local Canadian embassy, there in the United States, or the high commission or consulate and apply for a visitor's visa for your child. You can find a list here:

Once you are back in Canada, you can sponsor your child from within Canada. Find out more here:

They can help you with any paperwork for you, that needs to be filled out, and will help you to understand the process of bringing your child to Canada, including on the grounds of the Humanitarian & Compassionate application process.

Just a few observations on your reply to VAAT

1. There is no provision to sponsor a child from within Canada. In-Canada class is
only for Spouses and/or Common Law Partners. Therefore, he will have to file the
regular sponsorship application at CPC Mississauga and on sponsor's approval,
the file will move to USA for grant of Visa

2. As a US born citizen, the child does not need any visitor visa to enter Canada and
can accompany the sponsor into Canada.

3. Rightly said by you, he can seek assistance from any of the settlement agencies
in the neighbourhood

If you are planning to enter by road, border officer may send you to Immigration officer with yellow slip and she/he will ask you to provide evidence that you have been to Canada for said period, so be prepared and keep all documents in hand (credit receipt or whatever you have that show you have been to Canada).

Hi Freddie and pkalra,

Could you please help me on my case. I got my PR in aug 2003 and i stayed in different country for 3 years and now i am in canada with my family spending the 2 years compulsory period in order to retain my PR status. (I sponsored my wife & child and they are here in canada)

Now the problem is, my company may send me to India (maximum 2 weeks) regarding one of the outsourcing work. If i leave i will be shortage of 1 week for my PR. I just would like to know if the immigration people will consider those days as physically presence in canada.

Hello Praveen,

Thank you for setting the record straight. She can sponsor the child from USA and resettle here and wait for the follow up. Are there any charges for the sponsoring of a child? If so, how much?
She will have to cross the border with the baby and then provide the Canadian Mission with the NEW address after settling down. Would that be correct.
She can contact any of the offices of the Neighborhood Center close by and seek further assistance, if it calls for.

Hello Suresh,

Please obtain a letter from the firm you work for, to that effect.

Anyone who is employed by a Canadian Firm (In good Standing) and employed Overseas, does get credit for the time that they were short or absent from Canada. It is considered as if you were here all along.

Since it is only a very short period, they might provide you with the due credit and with the letter confirming your stay abroad was, done at their request and for their business, it will be weighed in your favour.
