Hi there,

Just wanted check regarding the counting of stay in Canada for Citizenship. I have completed three years stay in Canada amongthis three years stay there are three months business trips to USA from the company's work as I was working with sales and marketing company and I was travelling to USA a lot. Just wanted to know whether can I count my three months business trips to USA in the residence calculation for citizenship? If yes, what document should I present to CIC office?

As far as I know, you can claim the 3 months (towards your citizenship) so long as it was an official/ work visit outside Canada. You may however need to substantiate your claim with paper work, documents, etc. Your HR should be able to provide you with the letter. You could get more details from the CIC helpdesk.

I'm in a similar situation having recently completed 3 years since the date I became a PR; however have spent more than 6 months outside the country, substantially on my employer's business (my employers are a Canadian company).

I spoke to an immigration officer at the airport recently, who suggested that I go ahead and apply given my circumstances. The attached http://www.cic.gc.ca/english/citizen/calculator-faq.html (FAQ 2) from the CIC's website, however, suggests that the application processing 'will take longer' for such cases.

Chandresh: how long did the process take? I'm assuming that you applied 5 months short of physical residence in Canada.

The short answer to this is technically you CANNOT count your 3 months or 6 months spent outside Canada towards citizenship. However, it really is upto the judge to decide. The extra time that it would take is due to the fact that such cases would normally be adjudicated by a judge. I think in most cases a judge would grant it.

Sorry for a delayed reply - I didn't see your post earlier than today.

The whole process took me about 10 months - which was average at that time (in 2003-4), though for me it could have been a bit earlier had I not to go for the few test cases of finger printing (or perhaps they wanted to ensure that I was actually in town). These days I hear the process has been shortened to almost 3-4 months.

and Yellowknife - the case would go to a judge only if you are not allowed to appear for test or when your application is turned down. In my case, and as the link I have pasted would prove it, these are the guidelines for the processing officer and if a case falls within those guidelines, it is sort of an automatic eligibility. I had contacted a few immigration lawyers infact before puttin in my application and they said that there was no use for me to use their services for a clear cut case like this.
