Need advice Information on H-1 B Visa. Help !

Hi,

First of all, thank you for reading this posting, For those who take the trouble of replying thanks again.

My question concerns a H-1 B visa to work in the US.

I am awaiting my Canadian citizenship (which may be yet about 6 to 8 months away). Meanwhile. I have been offered a position in the US. I have a multiple entry visitors’ visa for the US, valid for 10 years/

My questions are:

1. How much is the total cost involved in the H-1 B visa process? Could you advise me about the break up of the cost – (lawyers fees and H-1 B visa processing fee at the US Consulate)?


2. How much time does it take to get the H-1 B visa stamped, from the day the application is filed?


3. Is it correct that entry for H-1 B holders will start only in October, even if it is issued earlier?

The company sponsoring your H-1B should be bearing all the costs such as filing fees, lawyer's fees, etc.
The *only* fee that you should have to pay is the visa stamping fee at the US consulate in Canada, although sometimes the employer agrees to re-imburse that as well.
But they shouldn't be asking you to pay the filing fees.

If you mean the application for stamping, then it takes only 1 day.
If you mean the start of the H-1B process, then it can be anywhere from 3 months to a year, depending on circumstances.
Since the H-1B quota for the year 2005-2006 will be effective from 1st October, if you application is filed now, you can expect it between October - December.

Yes, October will be the earliest, *unless* your job category is one not subject to the quota.
The company is required to put a start date on the application.
If they have indicated the earliest start date, then it will be October.
But if they have indicated a start date somewhere in Nov. or Dec. then that will be the effective date.

I believe you can enter the US upto 3 weeks prior to the start date on your H-1B visa.

Is any part of the H1 fees refundable, if not approved?

(doesnt matter who is bearing the cost).

If manufacture is recruiting at a entry level position similar to technician with wages $12/hr. What kind of visa is required for Canadian Immigrant. Will it be H1 and be part of the 65000 quote that we keep hearing about.

It doesn't sound like a case for H-1B.
H-1B jobs are those that require a minimum qualification of a bachelor's degree.
If the employer can prove that this job *requires* a minimum of bachelor's degree then an H-1B petition can be filed.
It will difficult to prove that an entry level technician position requires a degree.

AFAIK, no fee is refundable, except the "premium processing fees" in case BCIS does not return a decision within the 15 day period.
Even in that case, as long as they send a response back - even if it is an RFE and not a decision - the fees becomes non-refundable.
