My Spouse is a Canadian and I am a permanent resident since December 12, 1999. After almost 9 months later, My husband got a job in USa on H1 . We left for almost three years and came back in December 2003 before the deadline of PR card. I applied my citizneship in April 2003. I had to made a short visit in April and July 2003 from USA to complete the citizenship applications and test. In may 2004 judge refused our application . We have to wait again to 4 more years to apply as per judge. I cleared the citizenship test. My husband is about to loose the job from USa employer since we are stuck in Canada. My questions are
-Do I really have to wait for 4 years or I can get some concession since my husband is Canadian Citizen and on H1 and I am on h4.
-Does my time counts when I was phyically here . Say 9 months for my next application
-Do the immigration officer counts the time from the date I applied my last application or when the Judge made the decision in May 2004.
-Can I still travel outside canada?

May I suggest that since this section is particularly meant for Immigration expert, one should put in his comments only if Massood is not able to reply to it for say two days. This question has been answered by a member within two hours - however simple it might be.
I personally found two (rather 3 I might say) mistakes in this reply and that is why I would rather wait for Massood to reply first.

Did you tell them in your citizenship application that you were in thre US the last three years or did you put down canada as the place of your residence the last three years?
Beware what you write in your application. CIC is taking misrepresentation very very seriously these days. DON'T LIE.
Now, to answer your specific questions:

>> YOU DO NOT GET ANY CONCESSION. YOU HAVE TO MEET THE REQUIREMENTS. YOU CAN STAY IN CANADA FOR THREE YEARS AND APPLY.

>> YOUR TIME IN THE PAST FOUR YEARS IS COUNTED NOT EARLIER.
-Do the immigration officer counts the time from the date I applied my last application or when the Judge made the decision in May 2004.
>> YOU WILL HAVE TO COUNT BACKWARDS - FOUR YEARS FROM THE DATE OF YOUR NEW APPLICATION. IF YOU HAVE 3 STRAIGHT YEARS, YOU'RE OK TO APPLY.
-Can I still travel outside canada?
>> YES. YOU'LL NEED PR CARD TO RE-ENTER CANADA VIA COMMERCIAL VEHICLE.
