Applying for Skilled Worked PR from US

Hi,
I am a IT professional currently in the US. I want to apply for the skilled worked PR Visa from the US. I have been in the US for 2 years in the last 4 years and have been in the US since Jan 2008. Do I qualify to apply for PR from US. Also I was going throught the cic site and saw this under the FAQ section of Skilled Worker program.

\"Since Buffalo continues to use the regular application process, American citizens and other residents of the United States must submit a full application to our visa office in Buffalo, which will then forward it to the visa office closest to the applicant’s residence\"

What do they mean by the application being forwarded to the visa office closest tothe application residence? Does it mean that the application would be forwarded to the Indian VIsa office or do they have any other offices in US other than Buffalo, to which the application is forwarded.


Also i might have to leave US in Nov. What would happen to my application if I leave?

it is better to apply for PR from USA instead of India. It is taking 1 to 1.5 year for whole process. I think to qualify for an application, you must have atleast 1 year valid visa to stay in USA. Also, you must have to give IELTS exam prior to application.

If you are leaving USA in November for just vacation of few weeks, it should not be the problem. During application process, all paper communication will be sent to at your USA address.

Thanks for the response.

One of the requirement to apply in the US is as below in the cic site.

"you have been lawfully admitted into the United States for a period of at least one year and you are submitting your application at the Canadian visa office in Buffalo "

I have not completed 1 year during the current visit to US, but have stayed totally 2 years betwn 2004-08. If anyone else has been in a similar scenario and has successfully applied , please let me know.


My Visa is expiring in Nov. I will be applying for extension of the Visa but am not sure if it will be extended. If not I will have to go back to India get a new Visa and come back may be in a month. I wanted to know if this could cause any issues with my application processing. Can I change the address to any of my friends/relatives during this period. If I have a representative handling my application will that help? Can I use the representatives address when I am out of US?

As far as my knowledge, you must have 1 year valid visa / Extenstion permit to stay in USA from your date of application received at CIC. Otherwise, CIC simply send your application back to you and you may loose your fees.

Hi

I suggest you call the CIC call center to verify this.

I am in Canada and today I discussed this with CIC Call Center.

The rule says that you \"have been\" legally admitted in Canada for atleast 1 year. It no where says that you should have atleast 1 year valid visa at the time you apply for PR.

This is based on my today's discussion with CIC Call Center agent, However, I suggest that you call CIC and verify yourself. I hope same is valid for US
