Thanks to all for reply.

As per the police record I got to know her licence was expired in July 2006 and still she was driving the CAR. Because of her accident she left the car as it and just runway ( may be for some help ) . It was very fogged weather and she did not put any flashing light or anything else. It was on bridge and full of icey conditions as just after x'mas. I was entering that bridge through big curve on my 30-40 speed on right lane. Before I clear my thoughts or vision about that VEN and start controlling my car was too late as her car has occupied 1/4th place of my passing ( she was going to southbound and i was going northbound). I have 2 options either turn my car but i am scared with incoming and follwing traffic and there in no space for me for the right side. So i hit her ven in the corner.

My questions is though i am honest and said the true picture inspite of helping me TD meloche monex upset me. The case is still under investigations but my renewl is due in January and i got the letter yesterday that they just increase my insurance almost double becasue I hit . I was paying 189 to 1995 Toyoto corolla with full insurance now it is 334 for the same. When ever i said the case is still under process how can you my premium is high without anything is over. But no one listening me and when I called investigator officer he said we need 6-8 week to finalise. In some insurnace they fight for first time forgiveness but TD not one is ready to listen.

Any suggestions please.

Insurance companies in Canada are looking for an excuse to increase your insurance. I have no idea what to say in this case.

Man!! insurance rates are steep out there.

I was insured with TD and had a 5000$ claim settled in 2003 with NO premium change whatsoever. I have now switched and pay about $89/p.m on 2001 and 2007 cars...that means the claims not affected my record either.
In my case the other guy banged into my van(he had a stop sign ).

If you are sure its not your fault...It is VERY important to be confident(but not arrogant/angry/upset) that it is not your fault and to be firm about it to the investigator who calls. No 'maybe I could have', or pleading. Just be firm that it was not your fault and there was no way you could avoid the accident. Explain the facts clearly and in a way that places NO blame on your shoulders. This coupled with your honesty **may*** tilt the investigation in your favor. In my case the investigator made the decision after a phone call to my wife(who was the driver) and the other guy. He MAY have visited the site to see the stop sign....but the cars had definitely been moved the very night of the accident(nor did the cops show up or were photos taken) so that could not have figured.

Maybe the advice is too late for this time. I hope not. Be firm.

You should also explain to the investigating officer about the road condition. Just ensure that whatever you say does not go against you, ie road condition was bad but I was still doing 40 in a 40 zone. Just keep in mind you are supposed to drive according to road conditions.
