Questions on Spousal PR Application form

Hello,

Please help me with the following questions on filling out the sponsorship forms. Just a little background: My husband is Canadian; I am Indian; we have been living in USA for past 11 yrs on H1 and than EAD. We have 2 kids together (US & Canadian citizenship).

I am applying outland from India as everybody on this forum suggested as this is faster.

Please help me with the following questions:

1) Birth certificate - i have the original birth certificate from india, but it does not have my name; it shows my parents had a girl daughter on the said date; I have affidavit from my parents confirming my birth done for US GC; and I am wondering if these two pieces will work for birth certificate or do I need to apply for a new one??

2) Country of Residence (form 0008) - I am applying from India as it is faster; I have lived in US for the past 11 years(H1 and than EAD awaiting GC); and am currently in Canada (on tourist visa) -- What do I put as my country of residence??

3) Personal History (form 0008) - Do I write every job change; or just that I have been working for the past 11 years??

4) Mailing address for me - should I use the Canada address as I am here; or India address for my dad?? I don't want them to make my application Inland as everything on my form will suggest that I have never lived in India since I turned 18!

5) Option-C : We do not have this as we just moved back to Canada to settle. Just an employment letter from my husbands' work should suffice,. right?? We do not have any paystubs; but do have a good balance in our Canada and US accounts; should we show that??

6) On form 1344A question 4 -- our kids are already Canadian citizens'; do I put them on dependent children not accompanying?? Can I put my parents as not accompanying as we will be submitting their PR requests in future (as soon as I have mine done!!)

7) Form 5540 - Question 8 - Spouse's Address - are these since birth??

8) Form 5540 - Question 12 - Do you live with someone -> does he write ME???

The birth certificate with an affidavit is sufficient for the time being. Currently you can apply and obtain one with your name inserted and when you return back to India and have time on you hands, get one that will satisfy every one. The need will occur many more times, when you get your Citizenship, When you get your Canadian Passport, and when you ger Canada Pension etc., So, be on top of it and get these things completed and please retain copies also.

You have decided, for some odd reason to return back and apply from India. SO,
PLEASE provide them with an address where some one can receive all of the materials, including Couriers Post and Registered Posts etc., on you behalf, in your absence.

So the country is India and the address is also at one such place, there in India.

3) Personal history: Qualifications, Employed at and FROM, the start date and TO the last date in Chronological order. All of it and do not hide any of the jobs that you handled. (In the current day and age, they have all of it at their fingertips.)

4) Once you leave Canada you cannot return back, unless you apply for a VISA and obtain another. If you apply from Canada and pay the fees etc., and get out of Canada, they may consider that you have abandoned the application. So take all the papers to India and then submit them from there. AND be prepared to stay in India till all the matters pertaining to this application process is completed and you hang in there till it is done and you get your Indian Passport stamped for entry. SO, your address when you mail this will be in INDIA.

The address will be where you want the mail delivered and there is some one to collect it. Good to know that you never lived in India after you turned 18. Now they will get to know it too. All of these things will come out in the wash. Please fill the application forms correctly and get the PCC's done too.

5) A letter from the Employer giving his position and his emoluments and location etc., in it, will do. Please provide the financial details separately, as assets and liabilities.

6) Give the details as asked for. If they are Canadian Citizens, then you state that in the application or with a separate letter. Give the Passport Details to supplement the facts, together with Passport Pictures.

Include your Parents in the application, as not accompanying. (You can sponsor them later, if you so choose)

7) YES all of the places with addresses at which you stayed in Chronological order. The space will not be sufficient so give it on a separate sheet.

8) YES you are living in India with your Parents. Name and address and the relationship to go with it.
