Hi CD Members,
I received my first H1-B approval when I was Canada. (H1-B approval from October 2005 to October 2008)
At that time I went to Ottawa, Canada for H1-B stamping. It was written in I-129 and in Notice of action that I have to go to US consulate in Ottawa for stamping.
Now I am in USA since 2006 and before my H1 expires my employer filed for extension and it got extended to April 2011. Also, In notice of action, they have my I-94 form extended to April 2011.
Now, in I-129 it has been written,
Part 3 (My Name and Other Information)
Part 4. Processing Information
1. If the person named in Part 3 is outside the USA or
requested extension of stay or
change of status cannot be granted,
give the U.S. consulate or inspection fecility if this petition is approved.
Metamoros, Mexico
Now, I need to understand that do I really have to go to Mexico for stamping? I would like to go to USA Consulate in Canada might be in Ottawa or Toronto, rather than going to Mexico since I already have Canadian visa in my passport.
Well, I asked my Employer about it and he assured that I can go to any US consulate. But I need to confirm before I head out for Canada.
Please reply if you have gone through an H1B extension visa stamping process. Or anyone has any suggestions please.
Thanks in advance.
The consulate location stated in the I-129 was "requested" by your employer, usually, based on your citizenship or proximity to your physical work location. Having said that, your employer is right in that you can visit a consulate in Canada.
