Not right at all . You could file a 485 AOS by coming to US just 1 day before you file it . All the AOS does is that you will be in the country till you get your GC ..

There are reasons for AOS under 485. The most common ones are Labor and Marraige. For labor, you have to be employed and working in the US. So ofcourse you can come into the US for a day and apply, but you also have to had been working in the US to be eligible to apply.The one day rule you mentioned will not work.

My comments were only how Mr Khaki beat the system in Canada. He was trying to get the best of two worlds.

You could either commute daily to work from canada to US and maintain both the status's or move to US once you apply for cdn citizenship and then u can get simultaneous access to cdn passport and 485 etc.

I am not defending Kaki but just describing scenario where you could be legal and still get the best of both the worlds

First US and then canada by taking a foreign tax credit for the taxes paid in US and paying the balance to canada
