Hi - My wife is in canada on a study permit, would she be eligible to apply for dependant visa for me and my son? if so how soon she can apply after joining college/univ also how much time it is taking now a days to get the dependent visa for spouse and child.
BOTH of you must qualify for entry into Canada.
For your son to travel, either by himself or together with you and if he is a MINOR, then he will need a consent from both the Parents and it needs to get notarized and submitted along with the application for the study.
The minor child that will study will also need 'a study permit'. The age of Majority are given below and it depends upon the provinces as mentioned under this. (Where your spouse is currently studying)
Minor children – Study in Canada
Minor children must apply for a study permit if they want to study in Canada.
Who is a minor child?
In Canada, each province and territory decides the age when a person is considered to be an adult. This is known as the age of majority. A person under the age of majority is considered to be a “minor child.”
Province/Territory Age of Majority.. : IN Alberta, Manitoba, Ontario, Prince Edward Island, Quebec, Saskatchewan, it is.. 18
IN British Columbia, New Brunswick, Newfoundland and Labrador, Northwest Territories, Nova Scotia, Nunavut, Yukon, it is.. 19
Please go through the application first, before filling it, just to see what all it calls for. Also take a look at the DOCUMENT Check List also. Prepare well. Then if you have doubts please return back here with the document number and your questionnaire.
You will need to apply for a Temporary Resident Visa also. Try and get one with Multiple Entry to avoid any re-entry problems.
You can apply for a work visa after obtaining the TRV into Canada. You will also need health coverage for both of you. Look for service providers.
You will have to qualify FINANCIALLY, for the entry. It depends upon the duration of your spouse's study permit and it is also based upon, including the THREE of YOU, will be a large sum for starters. That amount should have been in the Banks as a BALANCE for a duration of TWO/Three months - minimum, while the application is in the process.
It will get completed within three months for the study permit. For the spousal visa it will take a little longer and you may have to show all of your assets, your current employers letter stating that you will resume work there with them upon your return and your FAMILY Ties there where you are currently living.
If you got all of your ducks in a row, then it will be sooner. Also ask your spouse to meet with the local MP (Member of the Parliament-FED) and inform him about her desire to have you both arrive in Canada. It may be just a phone call or it could be a visit to his local offices. Every thing that you can do to help yourself will enhance your chances and hasten your entry.
Hope this helps.
FH.
