I and a known friend of mine are working for Wipro. We both are Canadian citizens and working in USA on H1B status.
When it comes to H1B expiration of 6 years, my friend went to Canada for securing TN status. But he got denied(though all other necessary documents stands good) and reason told was that he is not "new hire. The issuance of TN is based on whether its new hire or not".
I am also sailing in same boat, can someone pl let me know whether i can go by taking 50-50 chances ? or will i also be denied on same grounds?
1. Is the position / job title same as that of when he was on H1?
2. Did his H1 expire or still valid?
The above 2 might have played a factor. In the end, it comes down to the officer's discretion if applied at the POE. If applied through USCIS (by mail), you or he might get a detailed review.
Answer to whether you'd be affected, yes, it's a 50-50 chance if you are in the same boat as him.

Seems like the attempt was made to secure the TN Visa based on past job letter !
