Hello Cd's

Submitted my request NOTICE OF INTENTION TO APPEAR ( form 8). The waiting period to get the trial date is 4 months approximately. Paying $ is not big deal. I would like to keep clean record . As I am already paying $300 insurance .

Did you request for a disclosure .. You should have done that 4 weeks ahead of the trial date and Prosecutor is obligated to provide you with all evidence they have .

If you have asked and the Prosecutor has not provided the evidence , you can cite this and get another date which can help you in pleading delayed trial under 11b

Worst case - if you go to the trial - first look for the cop who charged you --- keep on looking ... if you do not see him , do not claim 'guilt' ..Cop being absent , either case will be dismissed or you will get another date which will help you towards 11b.

If the cop is present , listen to the Prosecutor ..H/She will give you a plea bargain which means , she will lesser your fine and points if you plead guilty. You have to decide ..Most people give in .. few don't and go ahead with the trial.

Sunshine against your eyes and visor down may be an acceptable excuse - some times detectives look for this in case of an accident.

Prosecutor offering you the plea bargain will be the deciding point ..You will have to take the decision then.

UPDATE:
I haven't been logged into CD these days, here is the update on this topic.

Early Resolution is waste as I was not offered any deal..The prosecutor is very rude (may be in bad mood) and keep saying "Guilty or Not guilty"
I said not guilty and asked for trial.

Then, I went to admin and requested for disclosure.

I received the trial date and disclosure prior to that.

I could not figure out much from disclosure notes to my advantage (as advised in the ticketcombat portal, every thing is fine and cannot fight on the technicalities at that time. The only option left is postpone and hope not to get the cop.

My bad luck, cop did showed up during the trial,
After wasting the 1/2day and seeing the process, I have decided its not worth for me to fight in the trial.

Hence, when my turn came, I told judge gulty and the judge asked prosecutor about the fine, then she said some sections (don't remember but there are no points with them itseems) and no reduced fine.

Judge asked is it ok, I said yes thinking how fast I should leave this place and go to work (already lost 1/2 day pay).

Called my insurance as anonymous to find out the insurance raise having no point ticket and leant that...no point is BS..a conviction is conviction..i am S*r*d when my next renewal comes.

Hence, I would say that always go for trial and prey god that cop does not show. Also, there are very thin chances that prosecutor will give you deal as any deal is a conviction is recorded unless they dismiss the ticket which is unlikely as they need to finish their quota.

STOP sign is the biggest Money pit for municipalities. I started observing when ever they need the quota..simply come to any neighborhood and finish their target in 1 hour ( I hardly saw people did complete stop for 3 seconds and leave in the small neighborhood roads)

Just my 3 Cents
