Denied visa to visit ailing mom, NRI moves HC

CHENNAI: A highly-qualified US citizen of Indian origin is unable to visit his 90-year-old ailing mother here for over 13 years, as his visa has been cancelled and his new visa application is lying unprocessed for four months now.
His crime: During his last visit to India in 1997, Muthuvel Chelliah addressed several meetings and spoke about the plight of Tamils in Sri Lanka.
Muthuvel Chelliah is a popular personality among Tamils in the US, as he is president of Federation of Tamil Sangams of North America (FeTNA), an umbrella organisation representing over 3 lakh Tamils in the US. A physical scientist with the National Oceanic and Atmospheric Administration (NOAA), he has been awarded for his studies on developing prediction methods of tropical storms and hurricanes in the US. He is also an editor of a Tamil magazine, Mullai.
Muthuvel's mother, C Pappammal, who lives in Nagapattinam district, has now approached the Madras High Court seeking a direction to the government of India to permit her son to visit her.
Justice P Jyothimani, before whom her writ petition came up for hearing, has ordered notices to the Centre.
K Balu, her counsel, said that though persons of Indian origin do not need a visa to visit India, Muthuvel had obtained a visa and it first expired in 2002. Later, he got another visa for 10 years, valid upto 2012. However, when he planned to visit his mother in 2004, he was informed that the visa had been inadvertently granted' and that it had since been cancelled. As he did not receive any information for several years, Muthuvel applied for a new visa in September last year. He is yet to hear from the authorities.
In her petition, Pappammal contended that her memory and sight had been diminishing and that she was unable to hear properly too. Noting that she was not in a position to read his son's letters and converse with him over phone, she said her last wish and ambition was to see her only son before her death. She expressed an apprehension that if anything happened to her in the meanwhile, she would not be able to see her son forever.
She also submitted that her son had never spoken anything against India or Tamil Nadu or against any political leader. Till this date, Muthuvel had no knowledge as to why he was being denied visa and why he was not given an opportunity to explain his position to the authorities.
