First question is: Is the land that you came into or possessed Agricultural?
If so is it registered with the local authorities, such as the Municipality or with the registrar of properties under that title.
Now the next question is can it be changed to any other use by the way of payments to them or with tax filing.?
If yes to both of these, then you are flying high. Which means that you don't have to relinquish the possession.

Also since you have the ownership, go and work towards the re designation of the same, rather than fight with the Government. Stop farming and put it to other usage after you find how you could accomplish this feat.

Now with the cost of the land going up sky high, I have seen an encroacher and other trespassers in India being chased away with shot guns. I know of a Police case against a land owner for the discharge of a fire arm, in a trespass case. People will resort to all kind of actions to avoid losing it.

Did you EVER work on this land while you were able to when you were there in India. Do you have a set of pictures or albums to show such is the case. If so, do you want to return and restart farming. Then, you can get your PIO and return back to the land and apply to the Government and ask for the release of your land back to you for the tilling of it and claim that you are retiring back to the farm. A few are still trying and the Government has not made a decision yet in their favour. Join the GOPIO group and voice your opinion in that forum. They are the ones that are doing the fighting for all of us.

Keep us posted as to the newer developments at your end.

Good Luck.

Freddie.

That means all those punjabi families (Because most were farmers) who came here and became citizen will lose their inherited agricultural properties unless they sell it.

If it is true then I know many of them who are not aware of it and will end up losing it (because they usually give it on lease in India)

I knew that Canadian citizens cannot buy agricultural property but never know that if u already had it before becoming a citizen then u have to sell it.

ii) Person of Indian Origin (PIO)- that is an individual (not being a citizen of Pakistan or Bangladesh or Sri Lanka or Afghanistan or China or Iran or Nepal or Bhutan), who

1. at any time, held Indian passport, or
2. who or either of whose father or grandfather was a citizen of India by virtue of the Constitution of India or the Citizenship Act, 1955 (57 of 1955).
The general permission, however, covers only purchase of residential and commercial property and not for purchase of agricultural land / plantation property / farm house in India.

Actually I got the similar feedback from the real estate guy (my family friend as well) .He confirmed me Canadian PP is OK as long as you are a PIO.Per PIO definition I believe I don't need to really appy for the PIO or OCI to buy residential property:)

My question is still there

"What will happen to the agricultural property which u already own or will inherit from your parents after u become a Canadian citizen? To be more clear, u already had these assets before coming to Canada."

I am not talking about buying an agricultural property.
