Dear CD friends,

Would appreciate your views with regard to my daughter's circumstance, as follows:

1. She will complete her three year's stay in Canada in December 2008 and hence planning to file her citizenship application in December.

2. As she is planning to apply in US medical schools and also Manipal (India), she will have to travel out of Canada in June 2009 for her education.

3. Her PR card will expire in July 2009 and hence we are planning to apply for her PR card renewal in March 2009, hopefully she will get a renewed card for 5 years in June 2009.

4. Can she travel out of Canada using her renewed PR card when her citizenship application is under process.

5. Is it better to apply for citizenship with a Hamilton address or Brampton address.. what is the time scale for these two places for the final citizenship process.

6. What is the step by step process till we get the Canadian passport ?

a. Calling for test - will they give sufficient time when they call for the test, will she be able to travel to Canada from India to write the test.

b. After how many months from the test date they will call for interview with the judge.

c. Is the next step Oath and after how many months ? Is the Citizenship card issue immediately after this ?

d. After applying for the Canadian passport, how long they will take to issue the same ?

e. After the passport is issued, she will have to apply for visa to travel to India, how long the Indian Embassy will take to issue a student visa ?

f. Totally how many trips she will have to make to Canada, we would like to know how many breaks she will have to take from her education in India or US.

g. Date by which you expect her to finish all the above process and obtain the Canadian passport in hand for both Hamilton and Brampton address ?

h. Can you identify any flaws to the above route.. I would really appreciate your views ?

See that she completes the required days before filing. Even putting the date as one day before the completion can put the application process in trouble. Please date and apply at least after 2 weeks after you reach the eligibility date

She can after applying. There is no restrcition.

See if they accept PR card renewal 1 month before expiry dates and if so send it 1 month before. Also check the normal processing time. I think It will be just one or 2 months (max.) Other CD's to confirm.

Yes. She can.

Hamilton will be faster. Candidates for test writing will be full of East Europeans/ Latin Americans
Brampton will be slower than Hamilton. Candidates for test writing will be full of Punjabi's.
So depends of what you want.

a. Apply for Candian Citizenship. (aplication + fee)
b. They will send you acknowledgement and Book for test
c. They will call you for test
d. They will call you for Oath (if you pass) or to meet with judge if you donot meet the residency requirements of too much travel outside Canada etc...
On oath day they will give you the citizenship card
e. Apply for Canadian passport by filling an application process + fee. You will get it in 2 weeks.
f. Apply for Visa / PIO card/ OCI to go to India

Yup. Normal time is atleast 2 weeks to 4 weeks

Depends. Can vary from 6 weeks to 6 months . I am writing this for oath date without seeing the judge. As said you meet the judge only when you try to circumvent the process. Meeting the judge may take 1 year or so, if you are routed to that process.

See above (6 weeks to 6 months). But note that they will generally call you for oath by giving just 1 week notice or so. If you canot attend the oath, Call the CIC telling them that you canot attend oath at such a short notice and ask them what to do. CD's further input needed in this.

2 weeks or less
Quote:

General visa takes 1 week by post or 1 day in emergency. For student visa timing, check the Indian counsulate website (Toronto)

If she gets her PR card (renewed) and leaves, she needs a few hours for the test on the test day, then a few hours on the oath day. From the oath day, she has to stay atleast for 2 weeks in Canada since once she gets the oath, her Indian passport gets cancelled. She has to apply for the Canadian passport and then indian visa or student visa.

Hamilton : 6 months to 10 months
Brampton : 9 months to 14 months.

No flaws at all. Generally happens.
Only thing is that it will put a big dent in your pocket (money wise for the flight ticket on the hassle on coming to Canada 2 times for a few hours). Once she gets the citizenship card (on the oath day), she can apply for the candian passport the same day and get it in 2 weeks or less. then she has to go to the Indian embassy for the student's visa.
If she is not able to make it for the test or oath, Call the CIC and inform. They will tell you of the next process. They will set another date but again they canot tell you the date over the phone. It will be another random date 2 or 3 months beyond.

Hope this helps

Peace

Hi,
I have been following this thread and it has been very informative to me. Many questions I have are common and hence I have taken care not to repeat them. My situation is as follows:
I complete the 1095 days criterion for citizenship application in December 2008.
I landed in Canada in August 2005 (as a Permanent Resident) and returned to India in early September 2005. The reason is that I had to make arrangements to relocate myself permanently to Canada since I landed myself a job in B.C during the one month visit in August 2005.
In Jan 2006, I returned to Canada and have stayed in B.C. since then. And I complete 1095 days of continuous stay in Canada in December 2008.
I intend to apply for Citizenship in December 2008 and leave in Jan 2009 to India due to a family concern.
I have the following questions:
1) Is it likely that my citizenship application will have an issue due to physical absence from Canada between September 2005 to Jan 2006? Please note that in December 2008, I complete 1095 days after factoring this absence.

2) Do I need to notify CIC since my absence is going to be more than 2 weeks?
Or would it be better to notify CIC since my absence is going to be more than 2 weeks?

3) I will have given my local guardian's address in the citizenship application and will expect my local guardian to follow up any mails/notifications from CIC and inform me so that I could travel to Canada when required. Could there be any issues here?

4) I would like to know how to follow up on tax returns filing in March -April 2009 when I am away in India?

5) Is there a form to fill out to sever financial ties with Canada? If yes, when is the best time to fill out this form. My concern is that filling out this form should not come in the way of the processing my citizenship application and increase chances of routing my case to the citizenship judge.

6) At the time of citizenship test or oath taking ceremony, will the CIC be aware of my physical absence from Canada after submission of my citizenship application? If yes, how?

I would really appreciate your advise/help with the above questions.

Thanks,
VD
